A development height incentfve may be provided where a development severs the 1 <br />development rights from the fee interest of property that is designated as “agricultural 2 <br />lands of long-term commercial significance” by Snohomish County. 3 <br />b. The development rights being acquired must be certffied by Snohomish County. 4 <br />c. Each agricultural development right which is acquired shall entftle the developer to 5 <br />five thousand square feet of additfonal floor area. 6 <br />d. In order to implement this program cooperatfvely with Snohomish County, the city of 7 <br />Everett adopts Chapter 365-198 WAC, as now or hereafter amended, by reference. 8 <br />8. Parks, Outdoor and Common Areas. 9 <br />a. To receive an incentfve height bonus for public parks, a developer must either: 10 <br />(1) Dedicate land to the city as approved by the parks director, mayor and city 11 <br />council; or 12 <br />(2) Improve an existfng public park or open space, or provide funds in lieu of 13 <br />improvement, in an amount that is equivalent in value of a land dedicatfon, and 14 <br />as approved by the parks director. 15 <br />b. To receive an incentfve height bonus for outdoor and common areas, the developer 16 <br />shall provide outdoor and common areas in additfon to the minimum requirements set 17 <br />forth in EMC 19.09.050. 18 <br />9. Fee in Lieu Of. 19 <br />a. When Allowed. Where a fee in lieu of is allowed, the determinatfon of the fee must 20 <br />follow the requirements set forth in subsectfon (D)(9)(b) of this sectfon. 21 <br />b. Fee Calculation. 22 <br />(1) The in-lieu-of fee is based on the bonus provided. For example, if a 23 <br />developer wishes to pay an in-lieu-of fee to support two floors of affordable 24 <br />housing in return for four bonus floors, the fee is based on the two floors of 25 <br />affordable housing. 26 <br />(2) The in-lieu-of fee, as of July 1, 2020, is based on the zoning designatfon and 27 <br />values set forth below. The fee will be adjusted annually based on the 28 <br />adjustment process set forth in EMC 16.72.020. 29 <br />(A) Mixed urban zone: seven dollars and fifty cents per square foot. 30 <br />(B) Light industrial zone(s): six dollars per square foot. 31 <br />(C) Multffamily (UR3 and UR4) zones: five dollars per square foot. 32 <br />Fee Calculatfon Example No. 1: A developer wishes to provide a fee in lieu of 33 <br />providing affordable housing in the urban mixed zone. The developer wishes to 34 <br />support two floors of affordable housing, which would provide a height bonus of 35 <br />four additfonal floors.
