EVERETT 2044 <br />DEVELOPMENT REGULATIONS <br /> <br /> <br />6/17/2025 <br />DEVELOPMENT REGULATIONS <br />Page 204 <br />CHAPTER 19.25 LAND DIVISION GENERAL EVALUATION CRITERIA 1 <br />19.25.040 Evaluation criteria—Subdivision, short subdivision, unit lot land division, alteration or 2 <br />vacation. 3 <br />An applicatfon that complies with all of the following general evaluatfon criteria listed below, the 4 <br />requirements of Chapters 19.24 through 19.27 EMC and this tftle, and applicable city standards shall be 5 <br />approved. In any such approval, the city shall make written findings that the applicatfon has made 6 <br />appropriate provisions in accordance with the requirements of this sectfon. An applicatfon that does not 7 <br />comply with these criteria shall be denied by the city. 8 <br />A. Public Use and Interest. The proposed project and design shall promote the public use and interest in 9 <br />accordance with the standards established by the state, city, and Chapters 19.24 through 19.27 EMC and 10 <br />this tftle; 11 <br />B. Public Health, Safety, and General Welfare. The proposed project and design shall promote the public 12 <br />health, safety and general welfare in accordance with the standards established by the state, city, and 13 <br />Chapters 19.24 through 19.27 EMC and this tftle; 14 <br />C. Comprehensive Plan. The proposed project and design shall conform to the general purposes of the 15 <br />comprehensive plan; 16 <br />D. Unified Development Code. The proposed project and design shall meet the requirements of this 17 <br />tftle, including but not limited to the following: 18 <br />1. Chapter 19.06 EMC, Lots, Setbacks and Residentfal Densitfes; 19 <br />2. Chapter 19.26 EMC, Land Division Development Standards or Chapter 19.27 EMC, Unit Lot 20 <br />Land Divisions; 21 <br />3. Chapter 19.30 EMC, Flood Damage Preventfon; 22 <br />4. Chapter 19.33 EMC, Streets, Sidewalks and Pedestrian Circulatfon; 23 <br />5. Chapter 19.34 EMC, Parking, Loading and Access Requirements; 24 <br />6. Chapter 19.35 EMC, Landscaping; 25 <br />E. Natural Environment. The proposed project and design shall meet the requirements of 26 <br />environmentally sensitfve area regulatfons of this tftle and Chapter 19.43 EMC, Environmental Policy, and 27 <br />the State Environmental Policy Act, Chapter 197-11 WAC, if applicable; 28 <br />F. Drainage. The proposed project and design shall meet the requirements of the city’s drainage 29 <br />regulatfons in EMC 14.28 the stormwater management program (SWMP) and design and constructfon 30 <br />standards and specificatfons; 31 <br />G. Open Space and On-Site Recreation. The proposed project and design shall meet the requirements 32 <br />for open space and on-site recreatfon as defined in Chapter 19.09 EMC and EMC 19.12.210.
