EVERETT 2044 <br />DEVELOPMENT REGULATIONS <br /> <br /> <br />6/17/2025 <br />DEVELOPMENT REGULATIONS <br />Page 254 <br />• buffer between designated MICs and adjacent residentfal or mixed-use areas to protect both the 1 <br />viability of long-term industrial operatfons and the livability of adjacent areas. 2 <br />19.35.030, APPLICATION OF LANDSCAPING REQUIREMENTS. 3 <br />The planning department shall review and may approve, disapprove or approve with modificatfon all 4 <br />site/landscape plans for all uses and developments which are required to provide landscaping in 5 <br />accordance with the requirements of individual zones and the provisions of this chapter. No permit for 6 <br />use which is subject to the requirements of this sectfon shall be issued untfl the landscape plan for such 7 <br />use has been approved by the planning department. This chapter shall apply under the following 8 <br />circumstances: 9 <br />A. New Development. All new uses shall provide landscaping in accordance with the requirements of 10 <br />this chapter when the use-standards table indicates a partfcular landscape category applies to that use, 11 <br />or when a partfcular landscape category and/or additfonal specific landscaping requirements are 12 <br />imposed as part of a discretfonary permit review process. 13 <br />B. Expansions of or Alteratfons to Existfng Uses. The requirements of this sectfon shall apply to 14 <br />remodeling or expansion of existfng uses when the value of the new constructfon or alteratfon occurring 15 <br />within a two-year period is equal to or greater than thirty-five percent of the assessed value of the 16 <br />existfng improvements. Where conformance with this sectfon would create a nonconformity of parking 17 <br />standards or would conflict with the locatfon of existfng buildings on the lot, the planning director shall 18 <br />determine how the code is to be applied. Where a nonconformity with parking standards will be created, 19 <br />the planning director should consult with the city traffic engineer. In determining how to apply the 20 <br />landscaping requirements in such circumstances, the planning director may allow landscaping to be 21 <br />clustered on portfons of the site visible from adjacent streets and shall use the following criteria in 22 <br />deciding which of the landscaping requirements to adjust, listed in the order of highest importance: 23 <br />1. Compliance with street frontage landscaping standards; 24 <br />2. Compliance with perimeter landscaping standards; 25 <br />3. Compliance with internal area of parking lot standards; 26 <br />4. Compliance with other landscaping standards of this tftle. 27 <br />C. Change of Use or Occupancy. When the use of a building or lot changes to another use which does 28 <br />not involve expansion or remodeling as provided in subsectfon (B) of this sectfon, such use need not 29 <br />provide additfonal landscaping except under the following circumstances: 30 <br />1. Additfonal off-street parking is required, in which case the landscaping required by EMC 31 <br />19.35.080 shall be required for all new parking spaces or parking facilitfes provided. 32 <br />2. The use is subject to a review process in which the review authority has discretfonary 33 <br />authority as set forth in EMC Title 15, Local Project Review Procedures, in which case the review 34 <br />authority shall establish the minimum landscape requirements for the specific use. 35 <br />3. New uses, storage or other actfvitfes which take place outdoors are to occur, in which case 36 <br />the requirements of EMC 19.39.050 shall apply. 37
