The previous use did not comply with the requirements of the landscaping regulatfons in 1 <br />effect at the tfme it was established, in which case the new use shall comply with such 2 <br />requirements in effect at the tfme of establishment of the previous use. If the locatfon of existfng 3 <br />buildings prevents conformance with the requirements of this chapter, the planning director 4 <br />shall determine how the code is to be applied. 5 <br />D. Difference of Standards. Where there is a difference in the standards listed in this chapter and the 6 <br />specific requirements listed in individual zones, the more substantfal requirements shall be required. The 7 <br />planning director may permit alternatfve landscaping, as provided in EMC 19.35.190, when the overall 8 <br />site development plan proposed provides equivalent or better results than required by this tftle. 9 <br />19.35.040, LOCATION OF LANDSCAPING. 10 <br />Landscaping shall be located where indicated by Table 35-2. Where required landscape width exceeds 11 <br />the required setback, the landscape width may be reduced to the minimum setback width if the 12 <br />landscape type is increased to the next higher standard (e.g., Type III to Type II), except that where Type 13 <br />III landscaping is required along street frontages, it need not be increased to Type II landscape standards. 14 <br />19.35.050, LANDSCAPING TYPE DEFINITIONS AND REQUIREMENTS (TYPES I-IV). 15 <br />A. Type I: Visual Screen. Type I landscaping is intended to provide a very dense sight barrier to 16 <br />significantly separate uses and zoning districts. It shall generally consist of a mix of predominantly 17 <br />evergreen plantfngs including living trees, shrubs and ground covers. The choice and spacing of plantfngs 18 <br />shall be such that they will form a dense hedge sufficient to obscure sight through the screen within 19 <br />three years after plantfng. Where a sight obscuring fence is required, chain-link fencing with slats shall 20 <br />not be considered to be sight-obscuring. Type I landscaping shall consist of the following: 21 <br />1. Evergreen trees planted along the entfre length of the required buffer at intervals no greater 22 <br />than twenty feet on center. Trees shall be chosen and spaced so as to form an effectfve visual 23 <br />screen which creates a solid sight-obscuring barrier within three years of plantfng. Trees shall be 24 <br />a minimum of six feet high at the tfme of plantfng. 25 <br />2. Type I landscaping shall include a solid wood fence or masonry wall, or combinatfon of wood 26 <br />and masonry, six feet in height and located along the property line between the residentfal and 27 <br />nonresidentfal use. 28 <br />3. The entfre width of the required buffer shall be landscaped. The remaining area which is not 29 <br />planted with the sight-obscuring barrier shall be planted with shrubs and ground cover. Shrubs 30 <br />shall be at least two-gallon size and a minimum of eighteen inches high at the tfme of plantfng. 31 <br />Shrubs and ground cover shall be planted to attain a coverage of ninety percent of the plantfng 32 <br />area within three years. 33 <br />4. Lawns and other ground covers may be used to cover up to seventy-five percent of the 34 <br />landscape area which is not used for the sight-obscuring barrier. 35 <br />B. Type II: See-Through Buffer. Type II landscaping is intended to create a visual separatfon between 36 <br />uses and zones. Type II landscaping shall consist of: 37
