All landscaped areas shall be maintained reasonably free of weeds and trash. 1 <br />4. All required landscaping which is located within public right-of-way shall be maintained by 2 <br />the abutting property owner. 3 <br />5. All corner lots shall maintain a vision clearance triangle. See EMC 19.41.060 for additfonal 4 <br />standards. 5 <br />6. All LID stormwater management facilitfes shall also be maintained in accordance with the city 6 <br />of Everett stormwater management manual. 7 <br />B. A maintenance assurance device, as described in Chapter 19.41 EMC, shall be required by the 8 <br />planning department to ensure that landscaping will be maintained for two years, according to the 9 <br />approved plans and specificatfons. 10 <br />19.35.180, LANDSCAPE ENFORCEMENT 11 <br />When the city takes enforcement actfon to ensure that dead, diseased, stolen, vandalized, improperly 12 <br />pruned, or damaged plants are replaced, a two-year maintenance assurance device, as described in 13 <br />Chapter 19.41 EMC, shall be required for the replaced landscaping. 14 <br />19.35.190, ADMINISTRATIVE MODIFICATION OF LANDSCAPING REQUIREMENTS. 15 <br />A. The planning director may authorize a reduced width of plantfng or waive some or all of the 16 <br />landscaping requirements in the following instances: 17 <br />1. When existfng conditfons on or adjacent to the site, including, but not limited to, differences 18 <br />in elevatfon, existfng vegetatfon, or locatfon of buildings or utflitfes would render the 19 <br />requirements of this sectfon ineffectfve. 20 <br />2. When Type I visual screening is required, an applicant may request to use plantfngs that can 21 <br />be expected to form a healthy sight-obscuring evergreen hedge within three years in lieu of two 22 <br />rows of trees. In reviewing such a request for modificatfon, the planning director shall consider 23 <br />the applicant’s request in light of the intent of Type I landscaping and the nature of the use or 24 <br />development which is being screened. 25 <br />3. When the applicant proposes an alternatfve method of landscaping that would achieve the 26 <br />intent and purpose of the landscaping required in this tftle and which the director determines to 27 <br />provide equal or better treatment. Some examples include the use of natfve vegetatfon existfng 28 <br />on site, preservatfon of groves of trees, preservatfon of wetlands and/or wildlife habitat, 29 <br />increasing perimeter landscape width in strategic locatfons, providing unique focal points of 30 <br />interest, and plantfng trees or shrubs that do not meet the type or size requirements at a higher 31 <br />number and closer spacing. 32 <br />4. When development will occur in phases and development of subsequent phases will result in 33 <br />removal of landscaping required by this tftle. 34 <br />5. When the subject property abuts railroad right-of-way developed with rail facilitfes, the 35 <br />planning director may modify the landscaping requirements for that portfon of the property 36
