Landscaping required pursuant to this tftle shall be installed in accordance with the approved 2 <br />landscape plan prior to the issuance of a certfficate of occupancy or final project approval. An applicant 3 <br />may request a temporary certfficate of occupancy for an exceptfon to this requirement. If a temporary 4 <br />certfficate is issued, all required landscaping shall be installed within six months after issuance of the 5 <br />temporary certfficate of occupancy. The planning department shall require a performance assurance 6 <br />device, as described in Chapter 19.41 EMC, prior to issuing a temporary certfficate of occupancy. 7 <br />B. Prior to issuance of a final certfficate of occupancy, the planning department shall verify that the 8 <br />landscaping is installed in accordance with the approved landscape plan. The engineer of record shall 9 <br />certffy that plantfng areas were prepared and amended per the landscaping plan requirements, and that 10 <br />all constructfon debris was removed from the landscape areas prior to soil preparatfon and installatfon of 11 <br />plants. 12 <br />C. If the installatfon of the required landscaping or screening is not completed within the period 13 <br />specified, the performance assurance device may be used by the city to contract for completfon of the 14 <br />installatfon. Upon completfon of the installatfon, any portfon of the remaining security shall be returned. 15 <br />D. The planning department shall perform the final landscape and screening inspectfon prior to any 16 <br />performance assurance device being returned. Any portfon of the landscaping not installed properly 17 <br />shall cause the certfficate of occupancy to be withheld or revoked untfl the project is completed or cause 18 <br />the assurance device to be used by the city. 19 <br />19.35.170, LANDSCAPE MAINTENANCE AND MAINTENANCE ASSURANCE REQUIREMENTS. 20 <br />A. All landscape areas required by this tftle shall be maintained in accordance with the following 21 <br />standards: 22 <br />1. All landscaping shall be maintained with respect to pruning, trimming, mowing, watering, 23 <br />insect control, fertflizing, or other requirements to create a healthy growing conditfon, attractfve 24 <br />appearance, and to maintain the purpose of the landscape type. 25 <br />a. Pruning of trees must be consistent with ANSI A300 (Part 1) American Natfonal 26 <br />Standard for Tree Care Operatfons—Tree, Shrub, and Other Woody Plant Management—27 <br />Standard Practfces (Pruning) and companion publicatfon Best Management Practfces 28 <br />Tree Pruning. Required trees shall not be pruned to maintain a height below twenty feet, 29 <br />except as required under power lines or as approved through the landscape modificatfon 30 <br />process in EMC 19.35.190. 31 <br />b. The topping, shearing or pollarding of required trees is prohibited. 32 <br />c. Portfons of trees that extend over areas used by pedestrians or vehicle maneuvering 33 <br />or parking areas, or that abut driveways, shall be limbed up to a height of seven feet to 34 <br />maintain pedestrian and vehicle clearance and clear lines of sight. 35 <br />2. Topped, sheared, pollarded, dead, diseased, stolen, vandalized, improperly pruned, missing, 36 <br />or damaged plants shall be replaced within three months, or as required by this chapter. 37
