EVERETT 2044 <br />DEVELOPMENT REGULATIONS <br /> <br /> <br />6/17/2025 <br />DEVELOPMENT REGULATIONS <br />Page 278 <br />(1) Normal, routfne, and emergency maintenance or repair of existfng utflity structures 1 <br />or rights-of-way, including vegetatfon management; 2 <br />(2) Installatfon, constructfon, or modificatfon in improved street rights-of-way and 3 <br />replacement, operatfon or alteratfon of the following facilitfes: 4 <br />(A) Natural gas, cable communicatfons, telephone facilitfes, water and sewer 5 <br />lines, pipes, mains, equipment or appurtenances; 6 <br />(B) Electric facilitfes, lines, equipment or appurtenances, not including 7 <br />substatfons, with an associated voltage of fifty-five thousand volts or less; 8 <br />(3) Normal and routfne maintenance or repair of public streets, state highways, and 9 <br />public park facilitfes, including vegetatfon management. Maintenance and repair does 10 <br />not include any modificatfon that changes the character, scope, or size of the original 11 <br />structure, facility, or improved area, nor does it include constructfon of a maintenance 12 <br />road or the dumping of maintenance debris. 13 <br />g. Forest practfces on city-owned watershed property located in remote areas not contfguous 14 <br />to the Everett corporate boundaries, undertaken in accordance with the requirements of the 15 <br />State Department of Natural Resources. 16 <br />h. Minimal soil disturbance for site investfgatfve work necessary for land use applicatfon 17 <br />submittals such as surveys, soil logs, percolatfon tests and other related actfvitfes. Disturbed 18 <br />areas shall be immediately restored. 19 <br />i. Conservatfon measures intended to preserve soil, water, vegetatfon, fish and other wildlife 20 <br />and their associated habitat that do not involve adversely impactfng functfons of the critfcal 21 <br />area. 22 <br />j. Routfne maintenance of existfng landscaping and fencing including removal of invasive 23 <br />vegetatfon, that does not involve grading, excavatfon or filling. 24 <br />k. Modificatfon to existfng structures. Legally constructed structures and improvements in 25 <br />existence on January 13, 1990, that do not meet the buffer requirements of this chapter may be 26 <br />remodeled, reconstructed, expanded or replaced; provided, that the new constructfon or related 27 <br />actfvity does not further alter or increase the impact to the critfcal area or buffer as a result of 28 <br />the proposed modificatfon. For structures that are damaged or destroyed as a result of flood, fire 29 <br />or act of nature, restoratfon work shall be initfated by the applicant within one year of the date 30 <br />of damage or destructfon, as evidenced by issuance of a valid building permit. The work 31 <br />authorized by such permit must be completed within the term of the permits issued by the city, 32 <br />which includes any written extensions. Expansions and additfons shall not further encroach into 33 <br />a critfcal area or the portfon of the required buffer between the critfcal area and existfng 34 <br />improvements. Expansions within the critfcal area or buffer shall be limited to a maximum of one 35 <br />thousand square feet of impervious surface. To the extent feasible based on site-specific 36 <br />conditfons, expansions shall result in no additfonal hydrologic impacts from stormwater runoff 37 <br />by using techniques such as low impact development. Remodeling, reconstructfon, and 38 <br />expansions shall be subject to all other requirements of the zoning code. 39
