All exceptfons must be approved by the city through the review process listed in EMC 1 <br />Title 15 prior to the exceptfon applying. The following are exceptfons to the requirements of this chapter; 2 <br />however, the exceptfons listed in this sectfon stfll require compliance with the other requirements of this 3 <br />chapter, except as allowed by the exceptfon. The exceptfon may not be exempted from other state or 4 <br />federal regulatfons or permit requirements. Any incidental damage to, or alteratfon of, a critfcal area that 5 <br />is not a necessary outcome of the allowed development shall be restored, rehabilitated, or replaced at 6 <br />the expense of the property owner. 7 <br />1. New accessory structures up to one hundred square feet, including storage buildings and 8 <br />garden sheds. Where structures, lawns and associated improvements have been legally 9 <br />established within a buffer area, new structures may be placed within the outer fifty percent of a 10 <br />legally altered critfcal area buffer. The one-hundred-square-foot limit shall include all associated 11 <br />improvements such as walkways or other impervious areas. Only one such exceptfon per site or 12 <br />property is allowed. 13 <br />2. New accessory structures between one hundred one square feet and two hundred square 14 <br />feet. Where structures, lawns and associated improvements have been legally established within 15 <br />a buffer area, new structures and additfons to existfng structures up to two hundred square feet 16 <br />may be permitted within the improved portfon of the buffer as follows: 17 <br />a. The two-hundred-square-foot limit shall include all associated improvements such as 18 <br />walkways or other impervious areas; 19 <br />b. The new structure or additfon shall be placed within the outer fifty percent of a 20 <br />legally altered critfcal area; 21 <br />c. The new structure or additfon maintains a minimum setback of ten feet from the 22 <br />critfcal area; 23 <br />d. A minimum of one square foot of legally altered buffer area is restored for every one 24 <br />square foot of new structure; 25 <br />e. A critfcal area covenant is recorded; 26 <br />f. A habitat assessment is completed if within an F stream buffer; 27 <br />g. A fence and critfcal area sign are provided to protect the newly established buffer 28 <br />area; and 29 <br />h. Only one exceptfon per site or property is allowed. 30 <br />3. Wetland Exception. The following wetlands may be excepted from compliance with the 31 <br />wetland preservatfon and protectfon goals in this chapter. Mitfgatfon must be provided for any 32 <br />approved impacts per EMC 19.37.120. 33 <br />a. All isolated category IV wetlands less than four thousand square feet that meet all of 34 <br />the following criteria: 35 <br />(1) Are not associated with riparian areas or their buffers; 36 <br />(2) Are not associated with shorelines of the state or their associated buffers; 37
