EVERETT 2044 <br />DEVELOPMENT REGULATIONS <br /> <br /> <br />6/17/2025 <br />DEVELOPMENT REGULATIONS <br />Page 281 <br />(4) There is no new spanning of water between three and thirteen feet deep; 1 <br />and 2 <br />(5) There is no new increase in the use of materials creatfng shade. 3 <br />b. New docks are permitted subject to compliance with any WDFW HPA or U.S. Army 4 <br />Corps of Engineers permit conditfons. Piers and docks shall be located, designed and 5 <br />constructed so as to cause minimum interference with public use of the water surface 6 <br />and shoreline; to mitfgate the impacts to ecological functfon and critfcal areas; to avoid 7 <br />or minimize impacts to views; and to cause no undue harm to adjacent propertfes. 8 <br />c. New docks shall be a maximum of four feet in width and a maximum walkway width 9 <br />of four feet. Overwater surfaces shall be constructed of unobstructed gratfng which 10 <br />provides at least fifty percent of open surface area. Piles, floats or other parts of the 11 <br />structure that come in direct contact with the water shall be approved by applicable 12 <br />federal and state agencies for use in water and shall not be treated or coated with 13 <br />biocides such as paint or pentachlorophenol. Use of arsenate compounds or creosote 14 <br />treated members is prohibited. 15 <br />d. Only one dock shall be permitted for all lots in any short subdivision or subdivision 16 <br />that occurs after September 1, 2000. Such dock shall be shared between all lots in the 17 <br />short subdivision or subdivision. 18 <br />e. Covered overwater moorage, either fixed or floatfng, shall be prohibited. 19 <br />f. No dock may be located within fifteen feet of an interior lot line, unless shared with 20 <br />the owner of the adjacent lot, in which case no setback is required. 21 <br />g. No single-family lot shall have more than one dock. 22 <br />h. No dock shall exceed four feet in width, twenty-five feet in length or five feet in 23 <br />height above the ordinary high water mark on the landward side. 24 <br />6. Reasonable Use Exception. This sectfon does not apply to areas within jurisdictfon of the 25 <br />shoreline master program. 26 <br />a. Nothing in this chapter is intended to preclude reasonable economic use of property 27 <br />as set forth in this tftle. If the requirements of this chapter as applied to a specific lot 28 <br />would deny all reasonable economic use of the lot, development will be permitted if the 29 <br />applicant demonstrates all of the following to the satfsfactfon of the planning director: 30 <br />(1) There is no other reasonable use or feasible alternatfve to the proposed 31 <br />development with less impact on the critfcal area; and 32 <br />(2) The proposed development does not pose a threat to the public health, 33 <br />safety and welfare on or off of the subject lot; and 34 <br />(3) Any alteratfons permitted subject to the requirements of this chapter shall 35 <br />be the minimum necessary to allow for reasonable use of the property; and 36
