EVERETT 2044 <br />DEVELOPMENT REGULATIONS <br /> <br /> <br />6/17/2025 <br />DEVELOPMENT REGULATIONS <br />Page 282 <br />(4) The inability of the applicant to derive reasonable economic use of the 1 <br />property is not the result of actfons by the applicant in subdividing the property 2 <br />or adjustfng a boundary line, thereby creatfng the undevelopable conditfon after 3 <br />the effectfve date of the ordinance codified in this chapter; and 4 <br />(5) The proposal mitfgates the impacts on the critfcal areas and buffers to the 5 <br />maximum extent possible. 6 <br />b. Reasonable Use Decision Process. Whenever an applicant for a development 7 <br />proposal submits a reasonable use proposal to the planning director, the submittal shall 8 <br />include the following informatfon which will be used to evaluate the criteria for 9 <br />reasonable use exceptfon: 10 <br />(1) The locatfon, size, and descriptfon of the areas of the lot which are either 11 <br />critfcal areas, required buffers, or setbacks required by this chapter; 12 <br />(2) A descriptfon of the locatfon and area of the lot which is within setbacks 13 <br />required by other standards of the zoning code; 14 <br />(3) An analysis of the minimum development necessary to achieve “reasonable 15 <br />economic use” of the lot, including a narratfve which includes a factual basis for 16 <br />this determinatfon; 17 <br />(4) An analysis of the impact that the development described in this sectfon 18 <br />would have on the critfcal areas and buffer functfons, including an analysis of 19 <br />impacts on fish and wildlife resources; 20 <br />(5) An analysis of whether any other reasonable use with less impact on the 21 <br />critfcal areas and buffers is possible. This must also include an analysis of 22 <br />whether there is any practfcable on-site alternatfve to the proposed 23 <br />development with less impact, including reductfon in density, phasing of project 24 <br />implementatfon, change in tfming of actfvitfes, revision of lot layout, and/or 25 <br />related site planning consideratfons that would allow a reasonable economic use 26 <br />with less adverse impacts to the critfcal areas and buffers. The phasing analysis 27 <br />shall address whether pre-project mitfgatfon of impacts to buffers is feasible to 28 <br />reduce impacts on critfcal areas. The analysis shall also address stormwater 29 <br />impacts and mitfgatfon required by the city’s stormwater management 30 <br />regulatfons; 31 <br />(6) A design of the proposal so that the amount of development proposed as 32 <br />“reasonable economic use” will have the least impact practfcable on the critfcal 33 <br />areas; 34 <br />(7) An analysis of the modificatfons needed to the standards of this chapter to 35 <br />accommodate the proposed development; 36 <br />(8) A descriptfon of any modificatfons needed for the required front, side and 37 <br />rear setbacks, building height, and landscape widths to provide for a reasonable 38 <br />use while providing protectfon to the critfcal areas; 39
