EVERETT 2044 <br />DEVELOPMENT REGULATIONS <br /> <br /> <br />6/17/2025 <br />DEVELOPMENT REGULATIONS <br />Page 296 <br />J. “Motor vehicle” means any vehicle which is self-propelled, used primarily for transportfng persons or 1 <br />property upon public highways, and required to be licensed under RCW 46.16A.030. (Aircraft, watercraft, 2 <br />and vehicles used on rails or tracks are not motor vehicles as that term is used herein.) 3 <br />K. “New motor vehicle” means a motor vehicle manufactured after December 31, 1976, the equitable or 4 <br />legal tftle of which has never been transferred to a person who, in good faith, purchases the new motor 5 <br />vehicle for purposes other than resale. 6 <br />L. “Noise” means the intensity, duratfon and character of sounds from any and all sources. The terms 7 <br />"noise" and "sound" can be used interchangeably for purposes of this chapter. 8 <br />J. M. “Off-highway vehicle” means any self-propelled motor driven vehicle not used primarily for 9 <br />transportfng persons or property upon public highways nor required to be licensed under RCW 10 <br />46.16A.030. 11 <br />N. “Officially sanctfoned” means written approval given by the City. 12 <br />O. “Owner” shall mean any person, agent, operator, firm or corporatfon having a legal or equitable 13 <br />interest in the property; or recorded in the official records of the state, county or municipality as holding 14 <br />tftle to the property; or otherwise having control of the property, including the guardian of the estate of 15 <br />any such person, and the personal representatfve or executor or administrator of the estate of such 16 <br />person if ordered to take possession of real property by a court, as well as a bankruptcy trustee. 17 <br />P "Plainly audible" means any sound for which any of the content of that sound, such as, but not limited 18 <br />to, comprehensible musical rhythms, is communicated to a person using their unaided hearing facultfes. 19 <br />For the purposes of enforcement of this code, the detectfon of any component of sound, including, but 20 <br />not limited to, the rhythmic bass by a person using their unaided hearing facultfes is sufficient to verify 21 <br />plainly audible sound. It is not necessary for such person to determine the tftle, specific words or artfst 22 <br />of music, or the content of any speech. 23 <br />Q. “Person” means any individual, firm, associatfon, partnership, corporatfon or any other entfty, public 24 <br />or private. 25 <br />R. “Property boundary” means the survey line at ground surface which separates the real property 26 <br />owned, rented or leased by one or more other persons and its vertfcal extension. 27 <br />S. “Public highway” means the entfre width between the boundary lines of every way publicly 28 <br />maintained by the department of highways or any county or city when any part thereof is generally open 29 <br />to the use of the public for purposes of vehicular travel as a matter of right. 30 <br />T. “Receiving property” means real property within which sound originatfng from sources outside the 31 <br />property boundary is received. 32 <br />U. “Sound level” means a weighted sound pressure level obtained by the use of a sound level meter and 33 <br />weighted as specified in American Natfonal Standards Instftute Specificatfons, Sectfon 1.4-2014. 34 <br />V. “Sound level measurement procedures” means standardized procedures for the measurement of 35 <br />sound levels of sources regulated by this chapter and performed in accordance with the Washington 36 <br />State Department of Ecology rules, Chapter 173-58 WAC. 37
