EVERETT 2044 <br />DEVELOPMENT REGULATIONS <br /> <br /> <br />6/17/2025 <br />DEVELOPMENT REGULATIONS <br />Page 295 <br />A. “Administrator” means the Chief of Police or Building Official of the City of Everett, as applicable, or 1 <br />their designee. 2 <br />B. “dB(A)” means a sound level, measured in decibels, using the A frequency-weightfng network of a 3 <br />sound level meter. 4 <br />C. ”City” means the City of Everett, Washington. 5 <br />D. “District” means the land use zones to which the provisions of this chapter are applied. For the 6 <br />purposes of this chapter the following noise control districts shall be established which include land use 7 <br />zones designated in the Everett zoning code as follows: 8 <br /> 9 <br />For any land use zone not listed in this subsectfon C D, the Administrator may determine that the zone is 10 <br />substantfally similar to a zone listed in this subsectfon C D and may classify it similarly for purposes of 11 <br />this chapter. 12 <br />F. “Emergency work” means work made necessary to restore property to a safe conditfon following a 13 <br />public calamity, work required to protect persons or property from imminent exposure to danger, or 14 <br />work by private or public utflitfes for providing or restoring immediately necessary utflity service. 15 <br />G. "Impulse sound" means sound having the following qualitfes: the peak of the sound level is less than 16 <br />one (1) second and short compared to the occurrence rate; the onset is abrupt; the decay rapid; and the 17 <br />peak value exceeds the ambient level by more than ten (10) dB(A). 18 <br />H. "Leq" means the equivalent sound level, which is the constant sound level in a given tfme period that 19 <br />conveys the same sound energy as the actual tfme-varying A-weighted sound. The applicable tfme period 20 <br />for the Leq must be specified. 21 <br />I. “Motorcycle” means any motor vehicle having a saddle for the use of the rider and designed to travel 22 <br />on not more than three wheels in contact with the ground, except farm tractors and such vehicles 23 <br />powered by engines of less than five horsepower. 24 <br />Noise Control <br />District Land Use Zones <br />1. District I All residentfally zoned districts including but not <br />limited to R.S., R-1, R-2, R-2A, and UR3 and UR4 NR-C, <br />NR, UR4, and UR7; and the P-OS zone. <br />2. District II All business and commercially zoned mixed-use <br />districts including but not limited to NB, B, MU4 , <br />MU7, MU15, MU25, LI-MU1, LI2 and HI <br />3. District III All agricultural and manufacturing industrially-zoned <br />districts including but not limited to P-0S AG, LI, and HI <br />and WRM (See EMC 19.03.010 as currently enacted or <br />hereafter amended for all current zones).
