EVERETT 2044 <br />DEVELOPMENT REGULATIONS <br /> <br />6/17/2025 <br />DEVELOPMENT REGULATIONS <br />Page 51 <br />19.05.040, USE OF BASEMENT OR OTHER BUILDING SPACES IN THE MIXED URBAN USE 1 <br />ZONES. 2 <br />A. Purpose. The purpose of this sectfon is to allow basements or other spaces in buildings existfng in 3 <br />one of the the mixed use urban (MU) zones, as of the effectfve date of the ordinance codified in this tftle, 4 <br />to be considered for uses that are not otherwise permitted on a larger scale, but which, if properly 5 <br />designed and managed, would not create unacceptable significant adverse impacts on surrounding 6 <br />propertfes or the area in general. Other spaces, in additfon to basements in existfng buildings that, due 7 <br />to their locatfon or configuratfon are not readily usable for permitted uses, as determined by the 8 <br />planning director, may be considered using the process described herein. This process differs from the 9 <br />unlisted use process listed in EMC 19.05.070(B) in that uses that are not specifically authorized in the 10 <br />MU zones may be considered using the process described herein. 11 <br />B. Review Process. 12 <br />1. Any request to allow a use that is not otherwise permitted in the MU zones, as provided by 13 <br />this sectfon, shall be reviewed using Review Process II. 14 <br />2. Review Criteria. The following criteria shall be used as the basis for approving, denying, or 15 <br />conditfonally approving a request to allow the use of a basement space, or other space as 16 <br />provided herein, for a use not otherwise permitted in the MU zones. 17 <br />a. Traffic generated by the proposed use. 18 <br />b. Noise generated by the proposed use. 19 <br />c. Impacts from odor, vibratfon, dust or other nuisances. 20 <br />d. Aesthetfc character and quality of the proposed use. 21 <br />e. Public safety impacts. 22 <br />f. Compliance with building and fire codes. 23 <br />g. Hours of the day of proposed use or actfvity. 24 <br />h. Proposed management and operatfonal procedures to minimize and mitfgate 25 <br />potentfal impacts 26 <br />i. Other factors not specified herein that would create a conflict with the uses that are 27 <br />permitted in the MU zones. 28 <br />3. Action. Any proposal that gives the outward appearance of awhere the use or actfvity that is 29 <br />incompatfble with the intent and purpose of the MU zones shall be denied. The city shall retain the right 30 <br />to revoke a permit issued under this sectfon for a use that fails to comply with any conditfons of approval 31 <br />of said permit, or which operates in a manner inconsistent with representatfons made in the applicatfon, 32 <br />pursuant to Chapter 1.20 EMC. 33 <br />19.05.045, NEIGHBORHOOD COMMERCIAL 34 <br />A. The purpose of this sectfon is to allow small-scale neighborhood commercial uses in residentfal areas 35 <br />subject to specific development standards to ensure compatfbility. Uses identffied in sectfon C are 36 <br />permitted where meetfng the criteria in subsectfon B, subject to the standards in sectfon C. 37 <br />B.
