9 <br />Progressive Design Build General Conditions <br /> <br />registration number, as required in Title 82 RCW (RCW <br />39.04.350(1)(c); <br />iv. Not been found out of compliance by the Washington State <br />Apprenticeship and Training Council under chapter 49.04 RCW <br />for the one (1) year immediately prior to award (RCW <br />39.04.350(1)(e) <br />v. Receive training on the requirements related to public works and <br />prevailing wages under Chapters 39.04 and 39.12 RCW (RCW <br />39.04.350(1)(f) <br />vi. For the 3-year period immediately preceding the date of award, it <br />has not been determined by final and binding citation from <br />Department of Labor and Industries to have willfully violated the <br />provisions of RCW 49.48, 49.46, or 49.52. (RCW 39.04.350(1)(g) <br />d) No Serious safety violations in the last 3 years as posted under <br />Washington State’s Labor and Industry’s Workplace Safety & Health <br />OSHA. <br />e) Not be disqualified from bidding on any public works contract under <br />RCW 39.06.010 or 39.12.065(3) (RCW 39.04.350(1)(d). <br />f) Registration in the federal System of Awards Management (SAM.gov), <br />has a current Unique Entity ID, and are eligible for federal award with no <br />active suspensions or debarments. <br />g) If applicable hold an electrical contractor license, if required by Chapter <br />19.28 RCW; <br />h) If applicable hold an elevator contractor license, if required by Chapter <br />70.87 RCW. <br />i) If applicable hold a plumbing contractor license, if required by Chapter <br />18.106 RCW <br />j) Attests that the business has not been found non-compliant with <br />apprenticeship requirements under state law for the two-year period <br />immediately preceding the date of award. <br />k) Evidence of holding the appropriate level of bonding and insurance <br />required by the Design-Builder related to the work of the subcontract and <br />naming Owner as an additional insured with waiver of subrogation. <br />l) Attestation of no conflicts of interests with Owner or Owner staff. <br />2.7.4 Design-Builder assumes responsibility to Owner for the proper performance of the Work <br />of Subcontractors and any acts and omissions in connection with such performance. Nothing in <br />the Contract Documents is intended or deemed to create any legal or contractual relationship <br />between Owner and any Subcontractor or Sub-Subcontractor, including but not limited to any <br />third-party beneficiary rights. <br />2.7.5 Design-Builder shall coordinate the activities of all Subcontractors. If Owner performs <br />other work on the Project or at the Site with separate contractors under Owner’s control, Design- <br />Builder agrees to reasonably cooperate and coordinate its activities with those of such separate
