2025 FEDERAL OVERLAY, BROADWAY – CALIFORNIA ST TO 18TH ST SPECIAL PROVISIONS <br />FEDERAL AID# STBGUL-2715(012); COE PW# 3841 SP-29 May 6, 2025 <br /> <br />Consultant, DBE – An individual, partnership, firm, or corporation who meet the 1 <br />definition of a DBE which has been retained under a contract to provide technical or 2 <br />professional services. 3 <br /> 4 <br />DBE Commitment – The dollar amount and scope of work the Bidder indicates on 5 <br />each line of their DBE Utilization Certification (DOT Form 272-056) for each DBE 6 <br />firm. These Commitments will be incorporated into the Contract and shall be 7 <br />considered Contract requirements. 8 <br /> 9 <br />DBE Condition of Award (COA) Goal – An assigned numerical amount specified 10 <br />as a percentage of the Contract. At Bid, this is the minimum amount that the Bidder 11 <br />must commit to by submission of the DBE Utilization Certification form and, if 12 <br />necessary, by GFE Documentation. 13 <br /> 14 <br />Disadvantaged Business Enterprise (DBE) – A business that is owned and 15 <br />operated independently from other businesses and is certified by the Washington 16 <br />State Office of Minority and Women’s Business Enterprises, as meeting the criteria 17 <br />outlined in 49 CFR 26 regarding DBE certification. 18 <br /> 19 <br />Force Account Work – Work measured and paid in accordance with Section 1-09.6. 20 <br /> 21 <br />Good Faith Efforts (GFE)– Efforts to achieve the DBE COA Goal or other 22 <br />requirements of this Provision which, by their scope, intensity, and appropriateness 23 <br />to the objective, can reasonably be expected to fulfill the program requirement. 24 <br /> 25 <br />Good Faith Efforts (GFE) Documentation - The documentation of the Good Faith 26 <br />Effort. GFE Documentation is only required in the event that the Contractor is unable 27 <br />to fulfill the program requirements and shall follow the guidance of 49 CFR Part 26 28 <br />Appendix A. 29 <br /> 30 <br />Subcontractor, DBE – An individual, partnership, firm, corporation, or joint venture 31 <br />who meet the definition of a DBE and who is sublet part of the Contract. 32 <br /> 33 <br />Supplier, DBE – A Manufacturer, Regular Dealer, Distributor, or Transaction 34 <br />Facilitator who provides supplies or materials for the Contract. The role a Supplier 35 <br />performs is determined on a contract-by contact basis. 36 <br /> 37 <br />Manufacturer, DBE – A DBE firm that operates or maintains a factory or 38 <br />establishment that produces on the premises the materials, supplies, articles, or 39 <br />equipment required under the Contract. A DBE Manufacturer shall produce 40 <br />finished goods or products from raw or unfinished material or purchase and 41 <br />substantially alters goods and materials to make them suitable for construction 42 <br />use before reselling them. 43 <br /> 44 <br />Regular Dealer, DBE – A DBE firm that owns, operates, or maintains a store, 45 <br />warehouse, or other establishment in which the materials or supplies required 46 <br />for the performance of a Contract are bought, kept in stock, and regularly sold 47 <br />to the public in the usual course of business. To be a Regular Dealer, the DBE 48 <br />firm must be an established regular business that engages in as its principal 49 <br />business and in its own name the purchase and sale of the products in question. 50 <br />A Regular Dealer in such items as steel, cement, gravel, stone, and petroleum 51 <br />products need not own, operate or maintain a place of business if it both owns 52
