Leasing of equipment from a leasing 2 <br />company is allowed. However, leasing/purchasing equipment from the Contractor is 3 <br />not allowed. Lease agreements shall be provided prior to the subcontractor 4 <br />beginning Work. Any use of the Contractor’s equipment by a DBE will not be credited 5 <br />as countable participation. 6 <br /> 7 <br />The DBE does not perform a CUF if its role is limited to that of an extra participant in 8 <br />a transaction, contract, or project through which the funds are passed in order to 9 <br />obtain the appearance of DBE participation. 10 <br /> 11 <br />In order for a DBE traffic control company to be considered to be performing a CUF, 12 <br />the DBE must be in control of its work inclusive of supervision. The DBE shall employ 13 <br />a Traffic Control Supervisor who is directly involved in the management and 14 <br />supervision of the traffic control employees and services. 15 <br /> 16 <br />The following are some of the factors that the Engineer will use in determining 17 <br />whether a DBE trucking company is performing a CUF: 18 <br /> 19 <br />1. The DBE shall be responsible for the management and supervision of the 20 <br />entire trucking operation for which it is responsible on the contract. The 21 <br />owner demonstrates business related knowledge, shows up on site and is 22 <br />determined to be actively running the business. 23 <br /> 24 <br />2. The DBE itself shall own and operate at least one fully licensed, insured, 25 <br />and operational truck used on the Contract. The drivers of the trucks owned 26 <br />and leased by the DBE must be exclusively employed by the DBE and 27 <br />reflected on the DBE’s payroll. 28 <br /> 29 <br />3. Lease agreements for trucks shall indicate that the DBE has exclusive use 30 <br />of and control over the truck(s). This does not preclude the leased truck 31 <br />from working for others provided it is with the consent of the DBE and the 32 <br />lease provides the DBE absolute priority for use of the leased truck. 33 <br /> 34 <br />4. Leased trucks shall display the name and identification number of the DBE. 35 <br /> 36 <br />Truck Unit Listing Log 37 <br />In addition to the subcontracting requirements of Section 1-08.1, each DBE trucking 38 <br />firm shall submit supplemental information consisting of a completed primary 39 <br />DBE/FSBE Truck Unit Listing Log (DOT Form 350-077) and all Rental/Lease 40 <br />agreements (if applicable). The supplemental information shall be submitted in an 41 <br />electronic format to the Engineer prior to any trucking services being performed for 42 <br />DBE credit. Incomplete or incorrect supplemental information will be returned for 43 <br />correction. The corrected Primary Truck Unit Listing Log and any Updated Primary 44 <br />Truck Unit Listing Logs shall be submitted and accepted by the Engineer no later 45 <br />than ten calendar days of utilizing applicable trucks. Failure to submit or update the 46 <br />DBE Truck Unit Listing Log may result in trucks not being credited as DBE 47 <br />participation. 48 <br /> 49 <br />Each DBE trucking firm shall complete a daily DBE/FSBE Truck Unit Listing Log 50 <br />(DOT Form 350-077) for each day that the DBE performs trucking services for DBE 51
