2025 FEDERAL OVERLAY, BROADWAY – CALIFORNIA ST TO 18TH ST SPECIAL PROVISIONS <br />FEDERAL AID# STBGUL-2715(012); COE PW# 3841 SP-36 May 6, 2025 <br /> <br />The DBE trucking firm must own and operate at least one licensed, insured and 1 <br />operational truck on the contract. The truck must be of the type that is necessary to 2 <br />perform the hauling duties required under the contract. The DBE receives credit for 3 <br />the value of the transportation services it provides on the Contract using trucks it 4 <br />owns or leases, licenses, insures, and operates with drivers it employs. 5 <br /> 6 <br />The DBE may lease additional trucks from another DBE firm. The DBE who leases 7 <br />additional trucks from another DBE firm receives credit for the value of the 8 <br />transportation services the lessee DBE provides on the Contract. 9 <br /> 10 <br />The trucking Work subcontracted to any non-DBE trucking firm will not receive credit 11 <br />for Work done on the project. 12 <br /> 13 <br />The DBE may lease trucks from a truck leasing company (recognized truck rental 14 <br />center) but can only receive credit towards DBE participation if the DBE uses its own 15 <br />employees as drivers. 16 <br /> 17 <br />DBE Supplier 18 <br />The credit of a DBE Supplier is decided on a contract-by-contract basis based on 19 <br />what the role the proposed DBE Supplier will be performing. OECR will make 20 <br />determinations on whether a Supplier qualifies as a Regular Dealer, Distributor, or 21 <br />Transaction Facilitator based on their role for the Contract. 22 <br /> 23 <br />Manufacturer - One hundred percent (100%) of the cost of the manufactured 24 <br />product obtained from a DBE manufacturer may count towards the DBE COA 25 <br />Goal. 26 <br /> 27 <br />Regular Dealer - Sixty percent (60%) of the cost of materials or supplies 28 <br />purchased from a DBE Regular Dealer may be credited toward the DBE Goal. 29 <br />Distributor – Forty percent (40%) of the cost of materials or supplies purchased 30 <br />from a DBE Distributor may be credited toward the DBE Goal. 31 <br /> 32 <br />Transaction Facilitator - only the fees or commissions charged for assistance 33 <br />in the procurement of the materials and supplies, or fees or transportation 34 <br />charges for the delivery of materials or supplies required on the job site, may 35 <br />toward the DBE COA Goal provided the fees are not excessive as compared 36 <br />with fees customarily allowed for similar services. The reasonable fee shall not 37 <br />exceed 5 percent of the total cost of the goods or services. Documentation will 38 <br />be required to support the fee/commission charged by the DBE. The cost of the 39 <br />materials and supplies themselves cannot be counted toward the DBE Goal. 40 <br /> 41 <br />Changes in COA Work Committed to DBE 42 <br />The Contractor shall utilize the COA DBEs to perform the work and supply the materials 43 <br />for which each is committed unless prior written approval by the Engineer has been 44 <br />received by the Contractor. The Contractor shall not be entitled to any payment for work 45 <br />or material completed by the Contractor or subcontractors that was committed to be 46 <br />completed by the COA DBEs in the DBE Utilization Certification form. 47 <br /> 48 <br />Changes 49 <br />In the event a change results in a reduction to Work committed to a COA DBE, the 50 <br />Contractor shall substitute other remaining Work to that COA DBE if possible, to 51 <br />avoid a change to the total dollar amount to be applied towards the goal committed 52
