2025 FEDERAL OVERLAY, BROADWAY – CALIFORNIA ST TO 18TH ST SPECIAL PROVISIONS <br />FEDERAL AID# STBGUL-2715(012); COE PW# 3841 SP-35 May 6, 2025 <br /> <br /> 1 <br />DBE participation is only credited upon payment to the DBE. 2 <br /> 3 <br />DBE Prime Contractor and Subcontractor Participation 4 <br />Only take credit for the Work that the DBE contractor performs with its own forces 5 <br />and is certified to perform. 6 <br /> 7 <br />If the Prime Contractor, subcontractor, or lower tier subcontractor DBE subcontracts 8 <br />a portion of the Work of its contract to another firm, the value of the subcontracted 9 <br />Work may be counted toward the DBE Commitments only if the lower-tier 10 <br />subcontractor is also a DBE. 11 <br /> 12 <br />Work subcontracted to a lower-tier subcontractor that is a DBE may be counted 13 <br />toward the DBE Commitments only if the lower-tier subcontractor self performs a 14 <br />minimum of 30 percent of the Work subcontracted to them. 15 <br /> 16 <br />Work subcontracted by a DBE contractor to a non-DBE does not count towards the 17 <br />DBE COA Goal. 18 <br /> 19 <br />DBE Subcontract and Lower Tier Subcontract Documents 20 <br /> 21 <br />DBE Consultants 22 <br />A DBE firm providing a bona fide service, such as professional, technical, or 23 <br />managerial services, specifically required for the performance of the contract will be 24 <br />credited as DBE participation 25 <br /> 26 <br />Force Account Work 27 <br />When the Bidder elects to utilize force account Work to meet the DBE COA Goal, as 28 <br />demonstrated by listing this force account Work on the DBE Utilization Certification 29 <br />form, for the purposes of meeting DBE COA Goal, only 50% of the Proposal amount 30 <br />shall be credited toward the Bidder’s Commitment to meet the DBE COA Goal. 31 <br /> 32 <br />One hundred percent of the actual amounts paid to the DBE for the force account 33 <br />Work shall be credited towards the DBE COA Goal or DBE participation. 34 <br /> 35 <br />Temporary Traffic Control Participation 36 <br />If the DBE firm only provides “Flagging”, the DBE firm must provide a traffic control 37 <br />supervisor (TCS) and flagger(s), which are under the direct control of the DBE. The 38 <br />DBE firm shall also provide all flagging equipment for its employees (e.g., paddles, 39 <br />hard hats, and vests). 40 <br /> 41 <br />If the DBE firm provides “Traffic Control Services”, the DBE firm must provide a TCS, 42 <br />flaggers, and traffic control items (e.g., cones, barrels, signs, etc.) and be in total 43 <br />control of all items in implementing the traffic control for the project. 44 <br /> 45 <br />Trucking Participation 46 <br />DBE trucking firm participation may only be credited as DBE participation for the 47 <br />value of the hauling services, not for the materials being hauled unless the trucking 48 <br />firm is also certified as a supplier of those materials. In situations where the DBE’s 49 <br />work is priced per ton, the value of the hauling service must be calculated separately 50 <br />from the value of the materials in order to determine DBE credit for hauling 51 <br /> 52
