2025 FEDERAL OVERLAY, BROADWAY – CALIFORNIA ST TO 18TH ST SPECIAL PROVISIONS <br />FEDERAL AID# STBGUL-2715(012); COE PW# 3841 SP-81 May 6, 2025 <br /> <br />5-04.3(9)C4 Mixture Nonstatistical Evaluation – Pay Factors 1 <br />For each lot of material falling outside the tolerance limits in 5-04.3(9), the Contracting 2 <br />Agency will determine a CPF using the following price adjustment factors: 3 <br /> 4 <br />Table of Price Adjustment Factors <br />Constituent Factor <br />“f” <br />All aggregate passing: 1½″, 1″, ¾″, ½″, ⅜″ and <br />No.4 sieves <br />2 <br />All aggregate passing No. 8 sieve 15 <br />All aggregate passing No. 200 sieve 20 <br />Asphalt binder 40 <br />Air Voids (Va) (where applicable) 20 <br /> 5 <br />Each lot of HMA produced under Nonstatistical Evaluation and having all constituents 6 <br />falling within the tolerance limits of the job mix formula shall be accepted at the unit 7 <br />Contract price with no further evaluation. When one or more constituents fall outside the 8 <br />nonstatistical tolerance limits in the Job Mix Formula shown in Table of Price Adjustment 9 <br />Factors, the lot shall be evaluated in accordance with Section 1-06.2 to determine the 10 <br />appropriate CPF. The nonstatistical tolerance limits will be used in the calculation of the 11 <br />CPF and the maximum CPF shall be 1.00. When less than three sublots exist, backup 12 <br />samples of the existing sublots or samples from the Roadway shall be tested to provide 13 <br />a minimum of three sets of results for evaluation. 14 <br /> 15 <br />5-04.3(9)C5 Vacant 16 <br /> 17 <br />5-04.3(9)C6 Mixture Nonstatistical Evaluation – Price Adjustments 18 <br />For each lot of HMA mix produced under Nonstatistical Evaluation when the calculated 19 <br />CPF is less than 1.00, a Nonconforming Mix Factor (NCMF) will be determined. The 20 <br />NCMF equals the algebraic difference of CPF minus 1.00 multiplied by 60 percent. The 21 <br />total job mix compliance price adjustment will be calculated as the product of the NCMF, 22 <br />the quantity of HMA in the lot in tons, and the unit Contract price per ton of mix. 23 <br /> 24 <br />If a constituent is not measured in accordance with these Specifications, its individual 25 <br />pay factor will be considered 1.00 in calculating the CPF. 26 <br /> 27 <br />5-04.3(9)C7 Mixture Nonstatistical Evaluation - Retests 28 <br />The Contractor may request a sublot be retested. To request a retest, the Contractor 29 <br />shall submit a written request within 7 calendar days after the specific test results have 30 <br />been received. A split of the original acceptance sample will be retested. The split of the 31 <br />sample will not be tested with the same tester that ran the original acceptance test. The 32 <br />sample will be tested for a complete gradation analysis, asphalt binder content, and, at 33 <br />the option of the agency, Va. The results of the retest will be used for the acceptance of 34 <br />the HMA in place of the original sublot sample test results. The cost of testing will be 35 <br />deducted from any monies due or that may come due the Contractor under the Contract 36 <br />at the rate of $500 per sample. 37
