(iii) the redevelopment includes elements that address potential impacts on adjacent <br /> residential uses. <br /> WHEREAS, the City Council concludes: <br /> 1. The existing Safeway store provides a necessary service to the community; <br /> 2. The existing Safeway store is much smaller than grocery stores that have been constructed in <br /> the last 20 to 30 years in Everett; <br /> 3. The redevelopment proposed by the applicant provides much improved architecture, <br /> landscaping,pedestrian access, and aesthetic appearance on the gateway corridors of Rucker <br /> Avenue and 41St Street. <br /> 4. The redevelopment includes design elements that adequately address potential impacts on <br /> adjacent residential uses, specifically visual,noise and traffic impacts, and is therefore <br /> consistent with the policies of the Land Use Element. <br /> 5. The requested amendment to the land use map and rezone provides for the public health, <br /> safety and welfare. This is accomplished by the use of the Resolution of Intent to Rezone <br /> process which will ensure that the area to be rezoned is used for expansion of the existing <br /> grocery store, and not for piecemeal or fragmented strip commercial use; <br /> 6. The requested amendment to the land use map and rezone promotes the best long term <br /> interests of the Everett community. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. The land use designation of the Land Use Map of the Everett Comprehensive <br /> Plan for the Safeway property, located on the west side of the 4100 block of Terrace <br /> Drive, as depicted on"Exhibit A, Map #1,"which is attached hereto and incorporated <br /> herein by reference, as adopted by Ordinance#2021-94, is hereby amended from"1.2, <br /> Single Family Detached, 5 to 10 Dwellings per Gross Acre"to "4.4, Mixed Use <br /> Commercial—Multiple Family." The land use designation shall be implemented <br /> through a Resolution of Intent to Rezone. <br /> Section 2. This ordinance shall not become effective unless and until the City Council <br /> approves the vacation of Terrace Drive between 41st Street and 42nd Street. In the event <br /> the City does not approve said vacation prior to July 19, 2000, then this ordinance shall <br /> become null and void at such time. "Approve(s)"means the adoption of a street vacation <br /> ordinance by the Everett City Council which ordinance then becomes effective. <br /> Section 3. That should any section, subsection, paragraph, sentence clause or phrase set <br /> forth in this ordinance or its application to any person or situation be declared unconsti- <br /> tutional or invalid for any reason, such decision shall not affect the validity of the <br /> remaining portions of this ordinance or its application to any other person or situation. <br /> The City Council of the City of Everett hereby declares that it would have adopted this <br /> ordinance and each section, subsection, sentence, clause,phrase or portion thereof <br /> 3 <br />
