railroad right-of-way,and then Possession Sound. Exhibits 1, 2, and 39; Google Maps
site view.
Proposal
6. The project proposes to subdivide the 1.45-acre subject property into 25 unit lot
townhomes. Each attached townhome would be on a fee simple lot. The units would be
organized into six buildings, including one tri-plex,three buildings with four units each,
and two buildings with five units each. Ten lots would'fiont Mukilteo Boulevard in two
buildings, oriented with front doors facing the street. The proposed lots would range
from 1,142 to 1,525 square feet in area, each with a garage accessed by the internal drive
aisle. All units would be accessed by a looped drive aisle in a commonly owned and
maintained tract(Tract 998). At the northwest corner of the site,4,966 square foot Tract
999 would contain stormwater management facilities and open space. Both commonly
held tracts would provide landscaped areas. Common facilities within the subdivision
including open spaces, the access drive aisle, stormwater facilities, guest parking, and
landscaping, would be available to residents and maintained by an incorporated
homeowner's association. Exhibits 1, 3, and 4.
7. Three-and four-unit residential development and multifamily residential development are
allowed outright in the NB zone. EMC 19.05.080 Table 5-1. There is no minimum
density requirement in the NB zone;maximum density is one unit for every 500 square
feet of lot area. EMC 19.06.100 Table 6-6. The subject property could therefore support
up to 126 dwelling units. The proposed density is consistent with applicable code.
Exhibit 1.
8. Development in the NB zone is required to provide a minimum lot area of 5,000 square
feet, minimum lot width of 50 feet, minimum lot depth of 80 feet, and minimum lot
frontage of 40 feet. No maximum lot coverage by building is established. EMC
19.06.010 Table 6-1. However, through the unit lot land division process, the Code
requirements for individual lot width, depth, area, frontage, setbacks, and minimum
building site may be modified so long as density requirements are met. EMC
19.06.060.C.4. Thus, the proposed unit lot subdivision can create lots that do not comply
with the listed standards. Planning Staff noted that the subject property is approximately
240 feet wide and approximately 245 feet deep, with approximately 340 feet of lot
frontage and an overall area of approximately 1.45 acres. The parent lot is determined to
satisfy the standards in Table 6-1. Exhibit 1.
9. In the NB zone, there is no minimum front setback established;however, development is
required to provide a minimum 10-foot rear setback and a minimum five-foot side
interior setback. EMC 19.06.020 Table 6-2. As shown on the site plan, each building
provides a minimum of five feet side setback, and all lots provide a minimum of 10 feet
rear setback. Exhibit 3, Sheet C 3.0.
10. Site access would be by a single driveway Mukilteo Boulevard in the northeast corner of
the site. A looped, private access drive would provide rear loading vehicular access to
Everett Hearing Examiner
Findings, Conclusions,and Decision
Sage Homes Northwest LLC(REV1122-OOI) page 5 of 22
