This notice is not <br /> a reflection upon the abilities or credit of the Contractor. If you are dealing with a lending institution,ask your loan officer what procedure the institution follows <br /> to verify that Subcontractors and material suppliers are being paid when either you or your lender pays money to the Contractor.You may want to request <br /> lender supervision when dealing with lending institutions that provide interim or construction financing.See RCW 60.04.221 .You may ask the Contractor <br /> to disclose all potential lien claimants as a condition of payment. You or your lender can,instead of making progress payments only to the Contractor, make <br /> agreed upon number of jointly payable payments to the Contractor and various Subcontractors and/or suppliers as work progresses.There may be an <br /> additional cost from your lender for this additional service. For an additional cost,you may request the Contractor to post a Performance Bond.This will give <br /> you recourse in the event that the Contractor fails to properly complete its obligations pursuant to this Agreement.This will increase price to the Customer of <br /> the construction project. <br /> SECTION 2-DISCLOSURE STATEMENT:ELITE ROOFING&REMODEL,is registered with the state of Washington,registration number ELITERR892CA, <br /> and has posted with the state a bond or deposit of$12,000.00 for the purpose of satisfying the claims against the contractor for breach of contract including <br /> negligent or improper work in the conduct of the contractor's business.The expiration date of the contractor's registration is July of each year.THIS BOND <br /> OR DEPOSIT MIGHT NOT BE SUFFICIENT TO COVER A CLAIM THAT MIGHT ARISE FROM THE WORK DONE UNDER YOUR CONTRACT.This bond <br /> or deposit is not for your exclusive use because it covers all work performed by this contractor.The bond or deposit is intended to pay valid claims up to <br /> $12,000.00 that you and other customers, suppliers,subcontractors,or tax authorities may have.FOR GREATER PROTECTION YOU MAY WITHHOLD A <br /> PERCENTAGE OF YOUR CONTRACT.You may withhold a contractually defined percentage of your construction contract as retainage for a stated period <br /> of time to provide protection to you and help insure that your project will be completed as required by your contract.YOUR PROPERTY MAY BE LIENED.If <br /> a supplier of materials used in your construction project or an employee or subcontractor of your contractor or subcontractors is not paid,your property may <br /> be liened to force payment and you could pay twice for the same work.FOR ADDITIONAL PROTECTION YOU MAY REQUEST THE CONTRACTOR TO <br /> PROVIDE YOU WITH ORIGINAL"LIEN RELEASE"DOCUMENTS FROM EACH SUPPLIER OR SUBCONTRACTOR AT YOUR PROJECT.The contractor <br /> is required to provide you with further information about lien release documents if you request them.General information is also available from the state <br /> Department of Labor and Industries,telephone number 1-800-647- 0982 or 360-902-5226,or online at www.Ini.wa.gov/scs/contractors/and look in the left <br /> margin for the option:Find A Contractor. <br /> SECTION 3-CHANGES IN THE WORK:The Customer may request changes or modification in the scope of the Contractor's work.These requests may be <br /> identified and agreed upon orally or in writing.If agreed upon in writing,such changes or modification shall be identified and agreed upon in a written change <br /> order prepared by the Contractor and signed by both parties. Unless otherwise agreed by written change order,all changes and modifications ordered by the <br /> Customer shall by billed by Contractor and paid by Customer as provided in this Section 3.Payment for all changed and modified work shall be at the time <br /> of the next progress billing. Labor will be billed and paid at the following rates:Superintendent$60.00 per hour; Roofers$50.00 per hour;Carpenters <br /> $60.00 per hour;Other labor at$45.00 per hour.All labor rates may be substantially more or less than the actual cost of labor to the Contractor and include <br /> Contractor's labor burden,direct and indirect overhead,and profit.All materials,equipment,subcontractors,fees,permits,and other direct costs will be <br /> charged at list price plus 20% Contractors fee.Customer shall be responsible for all Washington State sales tax on Contractor's invoices.Any professional <br /> fees,costs,or studies requested by the Customer or required by governement officials will be paid by the Customer. <br /> SECTION 4-CORRECTION OR COMPLETION OF THE WORK:After the work is ready for the Customer's use or occupance,the Contractor and Customer <br /> shall jointly inspect the work and a single list shall be prepared identifying all work to be completed or corrected.There shall be only one such written list of <br /> work identified to be incomplete or incorrect,and the list shall be signed by the Customer and given to the Contractor.The Contractor shall then expeditiously <br /> complete all work stated on the list of which the Contractor is responsible under the terms of this Agreement.The Customer shall not contract with any <br /> alternative Contractor for the performance of the completion of the work within the scope of this Agreement,nor shall the Customer claim a credit or back <br /> charge for the cost of completing any items stated on the written punch list nor shall the Customer occupy or use the Contractor's work until and unless the <br /> contractor shall have first been given reasonable notice and the opportunity to correct the work stated on the punch list referred to above.If the Customer does <br /> contract with an alternative contractor to perform the pickup work or otherwise complete the project without first affording the above described opportunity <br /> to the Contractor to do so,or if the Customer com menses to use or occupy the space or work on which the Contractor performed work,the Customer then <br /> agrees to accept all work"as is"and thereby waives any claim against the contractor under the terms of this Agreement,including warranty claims. Upon the <br /> Contractor's completion or correction of the work identified on the single written punch list,any retainage or amount withheld from final payment shall be paid <br /> within the next fourteen(14)days to the Contractor. <br /> Continued on page 4 <br /> DS <br /> Initial <br /> page 2 <br />
