• r _ ORDINANCE NO. ' 32 An ordinance providing for the acquisition by condemnation of water rights in the Sultan 'River and its tributaries, and of land for a pipe-line from said Sultan River to Everett,dir- ecting the city attorney to institute condemnation proceedings for the purpose of acquiring said land and water rights, and declaring an emergency, WHEREAS, by Ordinance No. 1662 of the city of Everett, the city has authorized the construction of a pipe-line from the Sultan River to Everett, and the diversion of water from the said Sultan River and its tributaries to the city of Everett for municipal and domestic purposes, and WHEREAS, it is necessary that certain parts of the said land and of the said water rights be condemned, and WHEREAS, construction work has already begun upon said plant and it is necessary that title to said water rights and to such parts of said land as said city may need, be acquired forthwith, NOW THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That so much land as may be reasonably necessary for the construction, maintenance and operation of the said water system and supply lines from said Sultan River to Everett, includ- ing land sufficient for dams, storage reservoirs, flowage, and for the construction, maintenance and operation of the flow line from the Sultan River to Everett be, and the same is hereby condemned and appropriated to the public use for the purpose of supplying the city of Everett and the inhabitants thereof with water, said property as hereinabove enumerated .to be taken and appropriated, to be taken and appropriated only after just compensation has been made and paid into court for the owners of said property.
