Section 2: That there be and hereby is condemned for <br /> the use of the city of Everett and its inhabitants sufficient <br /> water out of the Sultan River and its tributaries, within Sno- <br /> homish County, to supply the said city of Everett and its in- <br /> habitants with an ample supply of pure water for all domestic <br /> and municipal purposes; and there is further hereby condemned <br /> and appropriated from the riparian land below the proposed <br /> intake of said water works in Section 32 of Township: 29 North, <br /> Range £ East such water rights appurtenant to said lands as <br /> may be necessary to enable the said city to divert said water <br /> and construct said works. The said water and water rights <br /> hereinabove described to be appropriated only after just com- <br /> pensation has been made or paid into court, for the owners of <br /> said property. <br /> Section 3: That the city attorney be, and he is hereby <br /> authorized and directed to file in the superior court of the <br /> state of Washington in and for Snohomish County petitions in <br /> accordance with the laws of the state of Tashington, asking <br /> that said lands and rights in lands, waters, and water rights <br /> hereinabove described, be condemned and appropriated for public <br /> use, and that just compensation to the owners of said system <br /> be fixed by the court or a jury, in accordance with the ueul <br /> and ordinary practice in such cases. <br /> Section 4: The coet and expense of acquiring said lands <br /> and water and water rights shall be paid wholly from the City of <br /> Everett Tater Supply Fund. <br /> Section 5: An emergency is declared to exist, and this <br /> ordinance shall take effect upon its passage and publication. <br /> Passed 1111 1 MIR Mayor. -,--- <br /> Atte <br /> City Clerk. <br /> Published Ins � � - <br />
