However, this contract is a renewal of the City’s current contract with SCPDA. In the <br />past two years, the annual amount spent on the contract has been less than $20,000. We expect <br />some increase from past years. <br />Project summary statement: <br />Individuals charged with misdemeanors and gross misdemeanors in the City of Everett are <br />prosecuted in Everett Municipal Court. Most defendants are unable to afford legal <br />representation and are classified as “indigent” under state guidelines. Under the U.S. <br />Constitution, all criminal defendants have the right to legal counsel. To fulfill this obligation, the <br />City must provide attorneys at its own expense for indigent defendants. <br />When a case is appealed, new legal counsel must be appointed by the City. This contract covers <br />legal services for indigent defendants who appeal their Everett Municipal Court convictions to <br />the Superior Court. These appeals are governed by the Rules for Appeals of Decisions of Courts of <br />Limited Jurisdiction (RALJ). <br />Recommendation (exact action requested of Council): <br />Authorize the Mayor to sign Agreement for Indigent Defense Services (RALJ Public Defender), <br />with Snohomish County Public Defenders Association. <br /> <br />City Council Agenda Item Cover Sheet
