1 <br /> <br />AGREEMENT FOR INDIGENT DEFENSE SERVICES <br />(RALJ PUBLIC DEFENDER) <br /> <br /> <br />This Agreement is dated as of date of last signature below, by and between the CITY OF <br />EVERETT, a Washington municipal corporation (the “City”) and Snohomish County Public <br />Defender Association (the “RALJ Public Defender”). <br /> <br />RECITALS <br /> <br /> The City has adopted standards for the provision of indigent defense services in EMC <br />2.108.390 et seq. <br /> <br />AGREEMENT <br />The parties agree as follows: <br /> <br /> 1. Scope of Services, Standards and Warranties. The RALJ Public Defender will <br />provide indigent defense services in accordance with the standards adopted by the City in EMC <br />2.108.390 as the same exists or is hereafter amended (hereinafter “Standards”). The RALJ Public <br />Defender individually warrants that the RALJ Public Defender, and every attorney and/or intern <br />employed by the RALJ Public Defender to perform services under this Agreement, has read and <br />is fully familiar with the provisions of the Standards adopted by the City. Compliance with these <br />Standards goes to the essence of this Agreement. <br /> <br /> 1.1 The RALJ Public Defender, and every attorney and/or intern performing <br />services under this Agreement, shall certify compliance with Supreme Court Rule and governing <br />case load quarterly with the Everett Municipal Court on the form established for that purpose by <br />court rule. A copy of each and every such certification shall be provided to the City <br />contemporaneously with filing. The RALJ Public Defender and every attorney and/or intern <br />warrants that he/she shall conform to the case load limitations not only with respect to services <br />under this Agreement but also with respect to his/her practice as a whole, including other contracts <br />for public defense and/or private practice. <br /> <br /> 1.2 RALJ Public Defender will maintain contemporaneous records on a daily <br />basis, documenting all work performed on a quarter of an hour basis on each assigned case. RALJ <br />Public Defender will maintain and provide to the City a quarterly report detailing: <br /> <br /> 1.2.1 the number of RALJ cases assigned during the period and the time <br />spent on each case; <br /> 1.2.2 the number of cases in which a brief was filed; <br /> 1.2.3 the number of cases in which oral argument was heard; <br /> <br /> 1.2.4 for each case: <br /> <br />1. The date on which the case was assigned to RALJ Public <br />Defender, and the attorney assigned to the case; and
