ORDINANCE NO3, 1 `e'1 An ordinance authorizing and empowering the city attorney to make certain written stipulations and agreements relating to the acquirement by the city of Everett of the water system now used for the purpose of supplying the city of Everett and the in- habitants thereof with water, and the property and rights used in connection with said system, and the compensation to be paid there- for, for the condemnation and appropriation of which water system, property, and rights an action is now pending; and declaring an eme rgency, WHEREAS, the city attorney has filed with the city clerk this llth d•ay of April, 1916, a written communication having attach- ed thereto copies of two certain proposed stipulations in writing, entitled "In the matter of the petition of Feierett, a municipal corporation, for the condemnation and appropriation of the water works system in and supplying the city of Everett, Everett, a muni- cipal corporation, petitioner vs Everett Improvement Company, and others, defendants", the same being the action begun by the city of Everett in the superior court of the state of Washington for tinohomish County, and in which action on the petition of certain respondents therein named an order of removal has been made for the removal of said action to the United States District court for the western district of Washington, nothern division, which said copies of said two stipulations are now before the city council and are to remain on file in the office of the city clerk, and WHEREAS, the making of said two stipulations is 'or the advantage of the city of Everett, for the speedy acquirement of said property, and said stipulations have been drawn in accordance with instructions given to the city attorney by the city council, NOW THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That the city attorney be and he is hereby author- ized and empowered to make and sign and mutually deliver to and
