p with the attorneys for the parties therein named, the two written stipulations, copies of which are attached to the said communica- tion of the city attorney referred to in the preamble of this ordi- nance this day filed with the city clerk, and now before the city council, one of which said stipulations provides for the condemna- tion and appropriation of said property, as described in the schedule thereto attached, fixing the market value thereof at the sum of Nine Hundred rinety-four mhoueand ( 994,000.0o) Dollars, providing for the retention of title and possession thereof in the present owner and lessee thereof until August 10th, 1916, the present owner and lessee being entitled to receive all revenue and earnings of said property until and including August 10th, 1916, and to be liable until and including August 10th, 1916, for all expenses of maintenance and operation of said property, and said stipulation containing other terms and provisions mutually satisfact- ory to the city of Everett and to the parties now interested in said property; and said second stipulation providing for the remanding of said cause on application of the city of Everett to said superior court of 0nohomish County, and containing other terms and provisions mutually satisfactory to the city of Everett and to the parties now interested in said property, section 2: By reason of the fact that the terms and provisions embodied in said stipulations respectively are offered to the city of Everett by the several parties in interest for immediate accept- ance, and by reason of the financial arrangements contemplated by the city of Everett necessary to the taking over of said water syst- em, and. other existing facts and circumstances, the enactment of this ordinance is a matter of urgency, and an emergency is declared to exist, and this ordinance shall take effect upon its passage and publication.
