The City is completing rooftop and HVAC upgrades that will affect <br /> the wireless facility by blocking antennas. T-Mobile proposes minor modifications to the rooftop <br /> installation to retain functionality of the site. This includes relocating one sector of antennas to <br /> another location on the rooftop and extending one sector of antennas in height. As landlord to <br /> T-Mobile, the City requested the modifications be completed by January. T-Mobile and Lynx are <br /> requesting an expedited permit review to accommodate this deadline. <br /> This application is submitted pursuant to Section 6409(a) of the Federal Spectrum Act and <br /> Federal Communications Commission ("FCC") rules. Section 6409(a) mandates that state and <br /> local governments must approve any eligible facilities request for the modification of an existing <br /> wireless tower or base station that does not substantially change the physical dimensions of such <br /> tower or base station. Below are the FCC's six "substantial change" thresholds for a wireless base <br /> station site, each followed by an explanation how this application does not exceed that threshold: <br /> 1) It increases the height of the structure by more than 10% or more than ten feet,whichever is <br /> greater. <br /> The proposed extended antenna tip height is an additional two feet at 151' overall and <br /> overall is still extending less than ten feet from the top of the penthouse structure at <br /> 1424". See Sheet A3.1 of the submitted plan set. <br /> 2) It involves adding an appurtenance to the body of the structure that would protrude from the <br /> edge of the structure by more than six feet. <br /> No part of the modification will extend six feet or more from the building structure.
