4 <br /> • <br /> water works system, and has been unable to agree with said owners <br /> upon a price therefor, and <br /> WHEREAS, It is necessary to condemn said water system in <br /> order to acquire title to the same at a reasonable and just value <br /> thereof, <br /> NOW THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That the water system now used for the purpose of <br /> supplying the city of Everett and the inhabitants thereof with water) <br /> and all property and rights of every kind used in connection with <br /> said water system as a part thereof, including the land, water, <br /> water rights, reservoirs, pipes, pumps, motors, boilers, buildings, <br /> structures, machinery, meters, hydrants, franchises, easements, <br /> grants, rights, and privileges, and all other property, whether real <br /> or personal, corporeal or incorporeal, used in connection with said <br /> water system or forming a part thereof, the said system being that <br /> now and heretofore used to supply water to the city of Everett, be, <br /> and the same is hereby condemned and appropriated to the public use <br /> for the purpose of supplying the city of Everett and the inhabitants <br /> thereof with water. <br /> Said system and property as hereinabove enumerated to be <br /> taken and appropriated only after just compensation has been made or <br /> paid into court for the owners of said property. <br /> Section 2: That the city attorney be, and he is hereby <br /> authorized and directed to file in the Superior Court of the state <br /> of Washington in and for Snohomish County a petition in accordance <br /> with the laws of the state of Washington, asking that said water <br /> system and its appurtenances hereinabove described be condemned and <br /> appropriated for public use, and that the just compensation to the <br /> owners of said system be fixed by the court or jury in accordance <br />
