Construction End Date: March 31, 2027 <br />Failure to meet this Project Development Schedule/Construction Schedule is considered a violation of the Grant Agreement and may <br />result in action by the Grantor to suspend and/or terminate the grant. The Project Development Schedule/Construction Schedule may only <br />be revised through prior approval by the Grantor. <br />8. The Grantee must seek written prior approval from the Grantor before the Grantee may alter the source or amount of funding that <br />contributes toward completing the project. <br />9. The Grantee shall not proceed with construction or demolition nor undertake any other ground -disturbing planning or project activities <br />without the Grantor's prior written approval of the following: <br />a. That the requirements of the National Environmental Policy Act have been met. This approval is contingent upon the Grantee's <br />submission of environmental analyses sufficient to sustain and document the Grantor's requirements under the National Environmental <br />Policy Act, to include all applicable conditions, avoidance measures, and mitigation measures when required. <br />b. That additional federal environmental requirements have been met. The Grantee will provide sufficient documentation to show that the <br />substantive and procedural requirements of applicable federal environmental laws, such as those listed in the National Policy <br />Requirements Article II and IV (Appendix B and D to 2 CFR Part 1122, respectively), were met. This term does not apply to project design, <br />development of environmental information or studies that include no ground disturbing work, administrative activities, securing permits, or <br />other activities that present no risk of irreparable injury to the environment. <br />10. Prior to the start of construction, the Grantee shall provide, for the Grantor's prior approval, written evidence of adequate access and <br />site control for a term of not less than the beneficial life of the improvements being made with Federal funds. <br />11. The Grantee shall not proceed with construction or demolition, nor undertake any other ground -disturbing project activities without the <br />Grantor's prior written approval of the Grantee's submission of a performance or surety bond sufficient for the completion of the activity <br />being undertaken with this award. <br />12. Real property, equipment, and intangible property that are acquired or improved through the use of Grantor funding must be held in <br />trust by the Grantee as trustee for the beneficiaries of the project or program under which the property was acquired or improved. With <br />respect to real property, the trust shall remain in effect for the entire Federal Interest Period specified in the Grant Awards Terms and <br />Conditions and the Federal Interest Supplement. The Grantee must work with the Grantor to establish sufficient Federal Interest, as by the <br />nature of the real property, equipment, and/or intangible property that are acquired or improved through the use of Grantor funding. <br />13. The Grantee is required to obtain all necessary easements and permits and provide written evidence of site control prior to breaking <br />ground on the project. If the Grantee is unable to secure these, it agrees that it will voluntarily terminate the grant award in accordance with <br />2 CFR part 200 upon written request from the Grantor. <br />page 3 of 4 <br />
