Any revisions necessary because of a review of the Recovery Schedule shall be resubmitted by the <br />Contractor for acceptance within two (2) calendar days of the review. The approved Recovery Schedule <br />shall then be the Schedule which the Contractor uses in planning, organizing, directing, coordinating, <br />performing and executing the work (including all activities of subcontractors, equipment vendors and <br />suppliers) for its one (1) month duration, to regain compliance with the CPM Schedule. <br />3. The Recovery Schedule shall also be submitted in electronic format. <br />1.05 SCHEDULE REVISIONS <br />A. Should the Contractor, after receiving approval of the initial CPM Schedule, desire to change his plan of <br />construction, he shall submit the proposed changes to the Architect and Owner. <br />1. He shall describe the logic for rescheduling the work and the method(s) for maintaining intermediate <br />milestones and shall confirm specific completion dates. <br />2. He shall revise his Schedule to include the effect of changes, acts of God or other conditions or events, " <br />which in the meantime have affected the CPM Schedule. <br />3. If the requested changes are acceptable to the Architect and Owner's Representative, they shall be <br />incorporated into the CPM Schedule in the next reporting period. <br />B. When the Owner requests changes by Construction Change Directive or Change Order, which has the potential <br />to impact the Contract Milestones or Specific Dates stipulated, a revised CPM Schedule will be prepared by the <br />Contractor and provided to the Architect and Owner clearly demonstrating the impacts. <br />C. Neither the updating or revising of Contractor's construction schedule for the Owner's review shall have the <br />effect of amending or modifying, in any way, the contract time, contract completion date or contract milestone <br />dates or of modifying or limiting in any way the Contractor's obligations under this Contract. <br />1.06 FLOAT TIME <br />A. Float time is defined as the amount of time between the earliest start date and the latest start date or between the <br />earliest finish date and the latest finish date of a chain of activities on the CPM Schedule. Float time is not for it <br />the exclusive use or benefit of either the Contractor or the Owner. Contractor's work shall proceed according to <br />Y <br />start dates, and the Architect and Owner shall have the right to reserve and apportion float time according to the <br />needs of the project. The Contractor acknowledges and agrees that actual delays, affecting paths of activities <br />containing float time, will not have any affect upon contract completion times, providing that the actual delays <br />do not exceed the float times associated with those activities. <br />B. A time extension, as described in the Contract Documents, will be granted only to the extent that an actual delay <br />exceeds the total float time available along the affected path of activities, and only if the affected path impacts <br />the established critical path. <br />C. The Contractor will not be entitled to any adjustment of the Contract Time, the Construction Schedule, or the <br />Contract Sum, or any additional payment of any sort by reason of the Owner's use of float time or by reason of <br />loss of float time, including time between the Contractor's anticipated completion date and the end of the <br />Contract Time, whether or not the float time is described as such on the Contractor's Construction Schedule. <br />mcg-ARC 2120.000 February 28, 2023 <br />
