r • • permitted by the said council, unless the agreement for such subletting or sub-contracting provides that the sub-contractor shall in all respects conform to the provisions of this ordinance , and a' copy of such agreement must, before the same becomes opera- tive, be filed in the office of the commissioner of public works of the city of Everett. Section 5 : No assignment or transfer of such contract or of any of the work provided for therein, and no subletting of such work or of any part thereof, which, by any scheme, device or subterfuge shall permit or secure the performance of labor upon such work at a less rate than the minimum scale therein provided for , or shall be recognized, approved or allowed by said commiss- ioner of public works, and any scheme or device by which the lab- orers employedupon such work shall sub-contract or sublet the same, or take any transfer or assignment o such contracts, or of any of the work herein provided for, as a partnership or other association whereby in lieu of receiving the minimum rate they shall receive a less sum in cash and become sharers in the pro- fits or losses of such work in compensation for their labor, shall be deemed a subterfuge, device, or scheme to avoid the provisions of this ordinance, and shall be null and void. Section 6: There shall be incorporated in all contracts and sub-contracts herein referred to all of the covenants, stip- ulations, agreements, promises and duties herein provided for>by. stating in such contracts in substance as follows: "I or we ( the contractor ) hereby agree to be bound to all the things, matters, promises, stipulations and consequences set forth and provided for in Ordinance No.1688 as fully and with like effect as if all said things, matters, promises, stipulations and consequences were set forth herein, and to that end said ordinance is made a part hereon
