traffic and transportation impacts within the scope of those programs will be required under those programs and shall supersede this chapter. The incorporation by reference and supplementation of certain definitions from RCW 82.02.90 in this chapter shall not be construed as the adoption of an impact fee program under the Growth Management Act. Avoidance of duplication between the requirements of this chapter and those programs shall be governed by RCW 82.02.100, RCW 43.21C.065, and section 12 of this chapter. Section 18: Definitions and usage 18.1. Usage. For purposes of this chapter, unless the context clearly requires otherwise: - Any official identified in this chapter includes any designee of or successor to that official. - Applicant refers to the person or entity proposing a project. Applicant includes private or public entities. Applicant includes the entity for which an authorized representative is submitting an application. Application includes any project permit application under EMC 15.12. - Environmental impact has the same meaning as in SEPA and includes: (a)effects on transportation network; (b)physical effects on people using the transportation network, such as public health and safety; and (c) effects of traffic or of the location or operation of transportation facilities on people and the environment, such as noise, air quality, and critical areas. - Fee for transportation system improvements refers to a fair share regulatory fee that is placed in a dedicated fund and that helps to address and mitigate a proposed project's impacts on the transportation system, as provided in this chapter, and does not refer to a method to raise revenue for the general fund to pay for transportation improvements. - Including means including but not limited to. - May is optional and permissive and does not impose a requirement. - Section and paragraph titles are not intended to have regulatory effect. - Shall is mandatory. - Singular includes plural and conversely, unless context clearly requires otherwise. 18.2. Definitions. Terms in this chapter shall have the same meaning as terms defined in: (1) EMC 20.04.030 (SEPA definitions incorporated by reference from WAC 197-11) and EMC 20.04.040 (additional SEPA definitions); and (2)RCW 82.02.090 (except that, as defined in section 18.3, "project improvements" shall be referred to as "local transportation improvements" and "system improvements" shall be referred to as "transportation system improvements" and are not limited to facilities identified in the capital facilities plan. 18.3. Additional Definitions.
