EMC 19.37.180.8.3.b authorizes the planning director to allow alteration or <br /> relocation of Type Np and Ns streams. EMC 19.37.180.G authorizes the planning director to establish stream <br /> buffers when a culverted portion of a stream is proposed to be restored to an open channel.The critical area <br /> report is on file along with a SEPA environmental checklist,which further details the critical areas on site and <br /> the stream restoration plan. <br /> Decision:The City of Everett Planning Director grants APPROVAL with CONDITIONS to daylight,relocate and <br /> restore the buffer of the Type Ns stream as detailed in the Critical Area Study and Stream Restoration Plan by <br /> Wetland Resources, Inc.,dated October 29, 2018.The following conditions shall apply: <br /> 1. An HPA permit must be obtained from Washington State Department of Fish and Wildlife (WDFW)to <br /> relocate the stream. <br /> 2. The design and installation of the stream crossing must be approved by WDFW. <br /> 3. The stream channel restoration must be monitored under the direction of a biologist. <br /> 4. The restoration shall follow the recommendations of the plan, including but not limited to the stream <br /> buffer planting plan,timing of plantings,spacing, mulching and seeding. <br /> 5. A biologist shall submit an as-built report to the Planning Division certifying initial compliance with the <br /> overall stream restoration plan. <br /> 6. An annual site inspection in the fall for five years is required by a biologist.Annual reports are required to <br /> be submitted to the Planning Division under project file number ESA19-005. <br /> 7.
