The following “Special Conditions” shall supplement the General Conditions and shall <br />become a part of this contract: <br />1.2 STATE INTEREST EXCLUSION CLAUSE <br />A. It is anticipated that this project will be funded in part by the Washington State <br />department of Ecology. Neither the State of Washington nor any of its departments or <br />employees are, or shall, be a party to this contract or any subcontract. <br />1.3 THIRD-PARTY BENEFICIARY CLAUSE <br />A. Third-Party Beneficiary: All parties agree that the State of Washington shall be, and is <br />hereby, named as an express third-party beneficiary of this contract, with full rights as <br />such. <br />1.4 GUARANTEE PERIOD AND MAINTENANCE BOND <br />A. Revise Correction Period in Section 00 72 00 General Conditions, Article 8.10 from one <br />year after the date of Substantial Completion to two years after Substantial Completion. <br />Revise the term of Maintenance Bond in Section 00 72 00 General Conditions, Article <br />15.2.2 from a minimum period of one (1) year after Final Payment to two (2) years after <br />Final Payment. <br />PART 2 - STORAGE, STAGING AND DUMPSTER AREAS <br />2.1 Location: Contractor will be responsible for storage of materials and equipment prior to <br />commencing installation phase. Staging of material and equipment during construction <br />phase will be located in designated areas and not interfere with storage facility <br />operations. Available space within the immediate area where work is to be performed <br />will be available for the contractor to stage material. <br />2.2 The contractor shall be responsible for the provisions for a dumpster(s). Location of a <br />dumpster shall be located within the staging area described above. Should a dumpster <br />not be possible due to site access limitations the contractor shall be responsible for an <br />alternate means of waste disposal.
