City of Everett 00 21 13 - 9 <br />Port Gardner Storage Facility - Facility Construction Package WO# UP-3525 <br /> <br /> <br />00 21 13 - 9 INSTRUCTIONS TO BIDDERS <br />1-02.11 Not Used <br />1-02.12 Public Opening of Proposals <br />1-02.12(1) Postponement of Opening <br />Proposals will be opened and publicly read at the time indicated in the call for Bids <br />unless the Bid opening has been delayed or canceled. Bidders, their authorized <br />agents, and other interested parties are invited to be present. <br />If an emergency or unanticipated event interrupts normal work processes of the City so <br />that Bids cannot be opened at the time indicated in the call for Bids the time specified <br />for opening of Bids will be deemed to be extended to the same time of day on the first <br />work day on which the normal work processes of the City resume. <br />The City reserves the right to postpone the date and time for receiving or opening of <br />Bids, or both, at any time prior to the date and time established in the Notice to Bidders. <br />Postponement notices shall be provided to Bidders in the form of addenda. <br />1-02.12(2) Video Conferencing <br />The City reserves the right to open and publicly read Bids by use of video- <br />conferencing, such as by Microsoft Teams, Zoom or other application. <br />1-02.13 Irregular Bids <br />1. A Proposal will be considered irregular and will be rejected if: <br />a. The authorized bid form furnished by the City is not used or is altered; <br />b. The completed bid form contains any unauthorized additions, deletions, <br />alternate Bids, or conditions; <br />c. The Bidder adds provisions reserving the right to reject or accept the Award, <br />or enter into the Contract; <br />d. A price per unit cannot be determined from the Bid Form; <br />e. The Bid Form is not properly executed; <br />f. The Bidder fails to submit or properly complete on the form provided by the <br />City a Subcontractor list, if applicable, as required in these Instructions; <br />g. The Bidder fails to submit or properly complete a RCW 35.22.650 <br />Certification, as required in these Instructions; <br />h. The Bidder fails to submit or properly complete a Non-collusion Affidavit, as <br />required in these Instructions; <br />i. The Bid Form does not constitute a definite and unqualified offer to meet the <br />material terms of the Bid invitation; or <br />j. More than one proposal is submitted for the same project from a Bidder under <br />the same or different names. <br />2. A Proposal may be considered irregular and may be rejected if: <br />a. If the Bid Form includes unit prices, the Bidder ’s Bid Form does not include a <br />unit price for every Bid item; <br />b. If the Bid Form includes unit prices, any of the Bidder’s unit prices are <br />excessively unbalanced (either above or below the amount of a reasonable <br />Bid) to the potential detriment of the City, as determined by the City; <br />c. Receipt of Addenda is not acknowledged;
