City of Everett 00 22 13 - 3 <br />Port Gardner Storage Facility – Facility Construction Package WO# UP-3525 <br /> <br /> <br />00 22 13 - 3 SUPPLEMENTAL INSTRUCTIONS TO BIDDERS <br />Category 2: Sensive informaon <br />Category 2: For official use only / disclosure permissible by law. <br />(2) Within the twelve years prior to Bid opening, the Bidder’s <br />superintendent must have successfully served (or be currently <br />successfully serving) as superintendent on at least one Similar <br />Excavation Project. This project must be a different project than <br />the project used for (c)(1). <br /> 3. Reliance on Experience of Others for Subsection 2(a). <br />If Bidder intends to rely on the experience of any other legal entity or entities to <br />satisfy the requirements of subsection 2(a) above, Bidder shall as part of its <br />submittal demonstrate why the experience of the other legal entity or entities <br />should be attributed to Bidder. By way of example (and not limitation): <br />(a) Successor. If Bidder is the successor to an entity and Bidder relies on the <br />experience of the predecessor entity to meet the requirements of <br />subsection 2(a), Bidder must demonstrate why the experience of the <br />predecessor should be attributed to Bidder. <br />(b) Past Joint Venture Experience. If Bidder was a participant in a joint <br />venture or other legal entity (whether partnership, limited liability <br />company, corporation or other business form) formed by two or more <br />contractors and Bidder relies on its experience as such a participant to <br />meet the requirements of subsection 2(a), Bidder must demonstrate why <br />that experience should be attributed to Bidder. <br />(c) Bidder Is Joint Venture. If Bidder is a joint venture or other legal entity <br />(whether partnership, limited liability company, corporation or other <br />business form) formed by two or more contractors and Bidder relies on <br />the experience of one or more of its members/partners to satisfy the <br />requirements of subsection 2(a), Bidder must demonstrate why the <br />experience of the member(s)/partner(s) should be attributed to Bidder. At <br />minimum, Bidder must submit the following information: <br />(1) A copy of the agreement and any related documents establishing <br />the relationship of the parties that constitute Bidder; <br />(2) Description of the business relationship between the parties that <br />constitute Bidder; <br />(3) Description of the specific roles and responsibilities each <br />member/partner of the Bidder will have in relation to the PGSF <br />Project; and <br />(4) List of past projects where the members/partners worked together <br />in the past and indicate the roles and responsibilities of each <br />member in relation to that project.
