All tools and equipment of the <br />Contractor and Subcontractors of any tier not intended as part of the <br />construction or installation of the Work will be the sole responsibility of the <br />Contractor. <br />15.4.4 Upon the occurrence of an insured loss, the Owner, as first named <br />insured, shall have the right to adjust and settle any loss with the insurers. <br />The Owner shall deposit in a separate account any monies received, and <br />shall distribute such funds in accordance with such agreement as the parties <br />in interest may reach. If no agreement is reached, any damaged Work shall <br />first be repaired or replaced, and payment therefor made from the separate <br />account by Change Order or by payment to a separate contractor, at Owner’s <br />option; further disbursements from the separate account will then be <br />determined by Owner <br />15.4.5 Partial occupancy or use in accordance with this Contract shall not <br />commence until the insurance company or companies providing property <br />insurance have consented to such partial occupancy or use by endorsement <br />or otherwise. The Owner and the Contractor shall take reasonable steps to <br />obtain consent of the insurance company or companies and shall, without <br />mutual written consent, take no action with respect to partial occupancy or <br />use that would cause cancellation, lapse or reduction of insurance.” <br />Item 12 - SPECIFICATION 00 72 00 GENERAL CONDITIONS: <br />Delete the Text of Section 15.3.9 and Replace with the following: <br /> “Contractor shall furnish separate evidence of insurance as stated above for <br />each Subcontractor or shall include all Subcontractors as insureds under its <br />policies. All coverage for Subcontractors shall be subject to all the <br />requirements stated herein and applicable to their profession. If Contractor <br />does not include Subcontractors as insured under Contractor’s own insurance <br />policies, Contractor shall be responsible for assuring that all Subcontractors <br />obtain all insurance as required by this Agreement and that the Owner be <br />specifically endorsed as an additional insured on such insurance. <br /> The insurance requirements for each Subcontractor are the same as for <br />Contractor, except that for subcontracts with value less than $1 million, the <br />requirements in 15.3.14.4 and 15.3.14.7 are adjusted for such subcontracts <br />as follows: <br />• The Bodily Injury and Property Damage limits from 15.3.14.4 shall be: <br />$ 2,000,000 General Aggregate <br />$ 1,000,000 Products & Completed <br />Operations Aggregate
