Bidder acknowledges that <br />they have not relied upon City or Engineer furnished information regarding site <br />conditions in preparing and submitting a Bid.” <br />Item 3 - SPECIFICATION 00 21 13 INSTRUCTIONS TO BIDDERS: <br />Delete Section 1-02.4(2) Subsurface Information and Replace with the <br />following: <br /> “If the City has made subsurface investigation of the site of the proposed <br />Work, the boring log data and soil sample test data accumulated by the City <br />will be made available for inspection by the Bidders. In addition, the City <br />makes no representation or warranty expressed or implied that: <br />1. The Bidders’ interpretations from the boring logs are correct, <br />2. Moisture conditions and indicated water tables will not vary from <br />those found at the time the borings were made, and <br />3. The ground at the location of the borings has not been physically <br />disturbed or altered after the boring was made. <br />The City specifically makes no representations, guarantees, or warranties as <br />to the condition, materials, or proportions of the materials between the <br />specific borings regardless of any subsurface information the City may make <br />available to the prospective Bidders. <br />If there is a geotechnical report made by the City, Bidder may contact the <br />Project Manager to arrange to view the geotechnical report.” <br />Item 4 - SPECIFICATION 00 43 36 PROPOSED SUBCONTRACTOR FORM: <br />Deleted entire Section and Replace with the attached Section 00 43 36. <br />Item 5 - SPECIFICATION 00 72 00 GENERAL CONDITIONS: <br />Delete Section 8.10 and Replace with the following: <br />“CORRECTION PERIOD <br />If within two years after the date of Substantial Completion, or such longer <br />period of time as may be prescribed by the terms of any applicable special <br />guarantee or warranty required by the Contract Documents) or by any specific <br />provision of the Contract Documents, any Work is found to be defective, or if <br />the repair of any damage to the land or areas made available for Contractor’s <br />use by Owner or permitted by Laws and Regulations as contemplated in <br />Paragraph 8.6.6. is found to be defective, Contractor shall promptly, without <br />cost to Owner and in accordance with Owner’s written instructions:
