CITY OF EVERETT SPECIAL PROVISIONS <br /> <br />Water Main Replacement “Y” – Ph 2 Div 1 – GEN REQUIREMENTS October 2025 <br />Work Order No. UP 3814 SP-43 <br />Category 2: Sensitive information <br />Category 2: For official use only / disclosure permissible by law. <br />Specifications: Includes 2025 WSDOT/APWA Standard Specifications and latest <br />Amendments, and all other specifications (including these Special Provisions) for the <br />prescribed Work in this Contract. (This definition replaces the definition in WSDOT 1- <br />01.3 for Specifications.) <br />Working Drawings: Drawings, shop drawings, plans, diagrams, or calculations, <br />including a schedule of submittal dates for Working Drawings where specified, which the <br />Contractor must submit to the Engineer. (This definition replaces the definition in <br />WSDOT 1-01.3 for Working Drawings.) <br />Supplement Section 1-01.3 by adding the following: <br />All references in the Standard Specifications to the terms “State,” “Department of <br />Transportation,” “Washington State Transportation Commission,” “Commission,” <br />“Secretary of Transportation,” “Secretary,” “Headquarters,” and “State Treasurer” shall <br />be revised to read “City.” <br />All references to the terms “State” or “state” shall be revised to read “City” unless the <br />reference is to an administrative agency of the State of Washington, a State statute or <br />regulation, or the context reasonably indicates otherwise. <br />All references to “State Materials Laboratory” shall be revised to read “City designated <br />location.” <br />All references to “final contract voucher certification” shall be interpreted to mean the <br />City form(s) by which final payment is authorized, and final completion and acceptance <br />granted. <br />Additive: A supplemental unit of work or group of bid items, identified separately in the <br />Proposal, that may, at the discretion of the City, be awarded in addition to the base Bid. <br />Alternative or Alternate: One of two or more units of Work or groups of bid items, <br />identified separately in the Proposal, from which the City may make a choice between <br />different methods or material of construction for performing the same Work. <br />Award Date: The date of the formal action by the Everett City Council to accept the <br />lowest responsible and responsive Bidder for the Work. <br />Bid Opening Date: The date the Everett City Clerk publicly opens and reads the Bids. <br />Business Day: A business day is any day from Monday through Friday except holidays <br />as listed in 1-08.5. <br />Change Order: Reference to Change Order shall include all rights of the City and <br />Contractor under 1-04.4 CHANGES. Agreed Change Orders shall be in the form <br />attached as Appendix C. Unilateral Change Orders shall be in the form attached as <br />Appendix C. <br />City: The City of Everett, Washington. “City” and “Owner” and “Contracting Agency” <br />mean the same. <br />City's Representative: The person designated in writing by the City to act as its <br />representative at the construction site and to perform construction inspection service <br />and administrative functions relating to this Contract. The terms “Engineer,” “Architect,” <br />or “Owner’s Representative” shall be interchangeable with City's Representative. <br />Contract Claim: Any request by the Contractor for additional time or money resulting in <br />adjustment of Contract Sum or Contract Time irrespective of the cause or reason for the <br />request. Contract Claims include, but are not limited to, requests by the Contractor for <br />additional time or money due to Extra Work, inefficiencies, Delays, interferences, and <br />problems with the design. Contract Claim includes, but is not limited to, claims or <br />requests by Subcontractors for extensions of Contract Time, adjustment of Contract
