CITY OF EVERETT SPECIAL PROVISIONS <br /> <br />Water Main Replacement “Y” – Ph 2 Div 1 – GEN REQUIREMENTS October 2025 <br />Work Order No. UP 3814 SP-79 <br />Category 2: Sensitive information <br />Category 2: For official use only / disclosure permissible by law. <br />1-06.1(5) Requests for Substitution <br />(******) <br />The City will not usually consider a substitution for material or Equipment specified by <br />brand name or manufacturer or sole-sourced. <br />Only the Contractor may offer materials or Equipment of equal or better quality and <br />performance as a substitution for those specified. The Contractor shall make substitution <br />offers in writing to the City’s Representative in accordance with 1-05.3(1) SUBMITTALS <br />of these Special Provisions. The substitution offer must include sufficient data to enable <br />the City’s Representative to assess the acceptability of the material or Equipment for the <br />particular application and requirements. The City and City’s Representative are not <br />required or obligated to consider or review a request for substitution and may, in their <br />sole discretion and option, consider or review such requests. <br />If the offered substitution requires changes to or coordination with other portions of the <br />Work, include, if any, drawings, and details showing such changes. The Contractor <br />agrees to perform these changes as part of the substitution of material or Equipment at <br />no additional cost to the City. Approval of a substitution request will not relieve the <br />Contractor from responsibility for the efficiency, quality, and performance of the <br />substitute material or Equipment, in the same manner and degree as the material and <br />Equipment originally specified. Reflect cost differential associated with a substitution in <br />the offer. If the City approves the substitution, the Contract Documents will be modified <br />by a Change Order modifying the Contract Sum in the amount of the cost differential. <br />1-06.2 Acceptance of Materials <br />1-06.2(2)B Financial Incentive <br />Delete 1-06.2(2)B. <br />1-06.2(2)D Quality Level Analysis <br />Delete 1-06.2(2)D. <br />1-06.3 Manufacturer’s Certificate of Compliance <br />Supplement 1-06.3 by adding the following: <br />When authorized by the Standard Specifications or these Special Provisions and prior <br />to use, the Engineer may accept certain Equipment on the basis of a Manufacturer’s <br />Certificate of Compliance as an alternate to Equipment inspection and testing. <br />A Manufacturer’s Certificate of Compliance shall be reserved for cases where <br />compliance to Contract requirements is not readily determinable through inspection and <br />testing of materials or Equipment. The Contractor shall provide properly authenticated <br />documents to the City’s Representative that the materials and Equipment comply with <br />the Contract requirements. <br />The Contractor shall pay all associated costs of providing each Manufacturer’s <br />Certificate of Compliance submitted for City acceptance. <br />The City reserves the right to refuse to accept Equipment on the basis of a <br />Manufacturer’s Certificate of Compliance. <br />1-06.3(1) Inspection at Point of Manufacturing <br />(******) <br />The Contractor shall be responsible to reimburse the City for the costs of inspections at <br />the point of manufacturing for inspections occurring outside of Whatcom, Skagit, Island, <br />Snohomish, King, Pierce, and Thurston counties. Costs to be paid or reimbursed by the <br />Contractor include, but are not limited to, travel, subsistence, labor, and lodging <br />expenses of the City Inspector.
