Operate on any public street or sidewalk, except as permitted under a <br />current and valid city-issued permit. <br /> <br />8.68.040 Exemptions <br />This chapter shall not apply to the following: <br />(1) Any federal, state, or local government agencies; <br />(2) Food trucks as defined in Chapter 5.32 EMC. <br />(3) Lemonade Stands, as defined in this Chapter. <br />(4) Nonprofit organizations, including but not limited to public, religious, civil, charitable, <br />benevolent, nonprofit, cultural or youth organizations; <br />(5) Farmers, gardeners, or other persons who sell, deliver or peddle any fruits, vegetables, <br />berries, eggs, or any farm produce or edibles raised, gathered, produced, or <br />manufactured by such person; <br />(6) Any persons regularly selling or delivering door-to-door to established customers food <br />products, laundry, dry-cleaning services, or baby diapers; <br />(7) Newspaper carriers who deliver door-to-door; <br />(8) Any person who is specifically requested to call upon others for the purpose of <br />displaying goods, literature, or giving information about any article, service, or <br />product; <br />(9) Bona fide candidates, campaign workers, and political committees campaigning on <br />behalf of candidates or on ballot issues and persons soliciting signatures of registered <br />voters on petitions to be submitted to any governmental agency; <br />(10) Vendors operating at a farmers’ or public market or other city-sponsored or approved <br />activity under the provisions of a city-issued permit. <br /> <br /> <br />8.68.050 Penalty <br /> <br />(1) A violation of this chapter by a Responsible Operator is a misdemeanor punishable by a <br />fine of up to $1,000, imprisonment for up to 90 days, or both. <br />(2) An Employer is guilty of a gross misdemeanor punishable by a fine of up to $5,000, <br />imprisonment of up to 364 days, or both, if he or she complicit in a violation of this <br />chapter, pursuant to EMC 10.06.050. <br /> <br />8.68.060 Enforcement <br />
