Samples of Materials <br />The Contractor shall provide Samples or specimens of materials to be incorporated in the Work that <br />require laboratory examination or special testing, as requested by the Owner’s Representative. Such <br />Samples or specimens shall be provided in ample time to permit making proper test analysis and <br />examinations before the Contractor plans to incorporate the material into the Work. An independent <br />testing laboratory will conduct tests of material in accordance with the Specifications. In the absence of a <br />specific test requirement, the Owner’s Representative will determine the appropriate standard test to be <br />used. <br />8.6.3. Certification <br />In cases where compliance of materials or Equipment to Contract requirements is not readily <br />determinable through inspection and tests, the Contractor shall provide properly authenticated documents, <br />certificates, or other proof satisfactory to the Owner’s Representative that the materials and Equipment <br />comply with the Contract requirements. These documents, certifications, and proofs shall include <br />performance characteristics, construction materials, and physical or chemical characteristics of materials. <br />The Contractor shall pay all associated costs of such certification. <br />8.6.4. Inspection at Point of Manufacturing <br />The Contractor shall be responsible and reimburse the Owner for the costs of inspections occurring <br />outside of Whatcom, Skagit, Island, Snohomish, King, Pierce and Thurston counties if (a) inspection and <br />testing of materials or Equipment in the vicinity of the Work by the Owner is not practicable, (b) the <br />Contractor requests the Owner to inspect and test material or Equipment at the point of manufacture, or <br />(c) the Specifications require that inspection, testing or witnessing of tests take place at the point of <br />manufacture. Costs to be paid or reimbursed by the Contractor include, but are not limited to, travel, <br />subsistence, labor and lodging expenses of the Owner’s inspector. <br />8.6.5. Testing and Commissioning of Completed Work <br />Testing and commissioning of all mechanical, electrical, and instrumentation systems and completed <br />portions of the Work, functioning as a completed system and the complete Project, functioning as a <br />completed facility, shall be done in accordance with the Specifications. <br />8.6.6. Storage of Materials and Equipment <br />Contractor shall store materials and Equipment so as to insure the preservation of their quality and fitness <br />for the Work. Stored Equipment and materials shall be located so as to facilitate inspection. The <br />Contractor shall be responsible for damages, loss or casualty occurring to materials and Equipment until <br />Final Acceptance. <br />8.6.7. Manufacturer's Directions <br />Manufactured articles, material and Equipment shall be transported, stored, applied, installed, connected, <br />erected, adjusted, tested, operated and maintained as recommended by the manufacturer, unless otherwise <br />specified herein. Manufacturer's installation instructions and procedures shall be provided to the Owner <br />prior to installation of the manufactured articles, material and Equipment. <br />8.7. DEFECTIVE WORK <br />8.7.1. Correction of Defective Work <br />When, and as often as the Owner’s Representative determines through his or her inspection procedures, <br />material, Equipment or workmanship incorporated in the Project do not meet the requirements of the <br />Contract, the Owner’s Representative will give written notice of the noncompliance to the Contractor. <br />Within fourteen (14) days from the receipt of such notice, the Contractor shall undertake the Work <br />necessary to correct the deficiencies, and to comply with the Contract. If the Contractor disagrees with <br />the Owner’s Representative's determination and believes that the corrective Work should be covered by a <br />Change Order, he or she shall immediately notify the Owner, in writing, setting forth its position.
