or immoral or suggestive conduct; and it shall be the duty of the <br /> person maintaining, conducting or having charge or control of such <br /> hall, to eject any person engaging in such prohibited conduct. <br /> Section 11: The Commissioner of Safety shall have super- <br /> vision of all dance halls , and shall have power to close up any such <br /> public dance hall when the same is a nuisance, because of lewd, im- <br /> moral or disorderly conduct carried on therein, and said commissioner <br /> or any member of the police department shall have free access to all <br /> public dance halls at all times. <br /> Section 12: Any person convicted of being a disorderly <br /> person, or convicted of violating any of the provisions of this <br /> ordinance, shall be deemed guilty of a misdemeanor, and punished by a <br /> fine of not more than one hundred ( 100) dollars , or imprisonment <br /> for a term not exceeding thirty (30) days, or both such fine and <br /> imprisonment. <br /> Section 13: That Ordinances Nos. 13, 14, 162, 345, 460, <br /> 464, 784, 812, 1078, and all ordinances and parts of ordinances <br /> in conflict herewith, be, and the same are hereby repealed; Provided, <br /> however, that no offense committed and no penalty or forfeiture <br /> incurred previous to the time when any ordinance is repealed, <br /> whether such repeal be expressed or implied, by this ordinance, shall <br /> be affected in any way by such repeal, and no prosecution for any <br /> offense or for the recovery of any penalty or forfeiture pending at <br /> the time of the taking effect f this ordinance, shall be affected by <br /> such repeal, but such offense, penalty or forfeiture shall be govern- <br /> ed by and such prosecution shall proceed under the ordinances exist- <br /> ing at the time of the commission of such offense or beginning of <br /> such prosecution, the same as if such ordinances were not repealed. <br />
