• • ORDINANCE. NO. N J Q0- An ordinance relating to excavations under, and digging into ,and disturbing the pavements of streets , alleys and sidewalks in the city of Averett, providing for permits therefor, prescribing the terms and conditions under which permits shall be granted there- for, repealing Ordinances numbers 626 and 663, prescribing punishment for the violation thereof, and declaring an emergency. TKO CITY OF AVARATT DOr1S ORDAIN: Section l: That no street, alley,sidewalk, place or square, now improved, or which shall hereafter be improved by parma- nent pavement, shall be opened, excavated, or the surface or founda- tion thereof in any manner disturbed or broken, in said city, without a permit first had from the Superintendent of Streets. Section 2: Applications for such permit shall be made to the Superintendent of Streets , setting forth the plans of such work, its nature and location, and before granting such permit the Super- intendent of Streets shall prescribe such terms and conditions as he may see fit, and require such deposits and assurances as in his judgment will be sufficient to provide for the restoration of such street, alley or sidewalk, and to fully protect the city from any liability because of such disturbance of any street, alley or side- walk. Section 3: All such work shall be done under the direction of the Superintendent of Streets, and it shall be his duty to see that the regulations and conditions prescribed by him concerning the same are fully and faithfully performed. Section 4: For the purpose of this ordinance , the term "permanent pavement" as used herein, shall be taken to mean any pave- ment or covering of which stone, brick, wood blocks , planking, con- crete, asphaltum, rock or macadam form a part of the surface or
