ORDINANCE NO. 2518-01 AN ORDINANCE amending Ordinance No. 251-73 (Chapter 5.108 Everett Municipal Code) providing for registration of persons, associations or organizations that conduct bingo games, raffles, social card games and or amusement games, or that utilize, display, exhibit or possess pull tabs or punch boards with the intent to sell chances thereon or to distribute for sale pull tabs or punch boards. WHEREAS, the City of Everett imposes a tax on the gross proceeds of gambling activities by Chapter 9.41 RCW, on persons, associations or organizations that conduct bingo games, raffles, social card games and/or amusement games, or that utilize, display, exhibit or possess pull tabs or punch boards with the intent to sell chances thereon or that distribute for sale pull tabs or punch boards (persons conducting gambling activity); and WHEREAS, the City of Everett implements such tax through Chapters 3.36 and 5.108 Everett Municipal Code (EMC) and is empowered under Chapter 9.41 RCW to obtain necessary information sufficient to ascertain the correct identities, gross receipts from persons conducting gambling activity and other information pertinent to the imposition and collection of gambling tax; and WHEREAS, the enforcement of the provisions of Chapter 3.36 Everett Municipal Code imposing a gambling tax under RCW 9.41.110 and a lien on property under RCW 84.60.010 on persons conducting gambling activity, necessitates the City obtaining accurate and current information about those licensed by the state to conduct such games which would be best maintained by a requirement of annual registration; and WHEREAS, under EMC 3.36.060 present gambling tax rate has increased in the year 2001 to 7.5 percent of gross proceeds of gambling and in the year 2002 it will increase to 10 percent; and WHEREAS, because the above mentioned increase in the gambling tax rate obviates any further need for an annual registration which is presently imposed by Ordinance No. 251-73 and Chapter 5.108 EMC; NOW, THEREFORE,THE CITY OF EVERETT DOES ORDAIN: Section 1: Section 1 of Ordinance No. 251-73 (EMC 5.108.010)which reads as follows: Section 1: It shall be unlawful for any person, association or organization to conduct bingo games, raffles and amusement games unless such person, association or organization complies with the following conditions: a. That the activity be specifically authorized pursuant to the requirements of Chapter 218, Laws of 1973, 1st Ex. Sess. 1
