Section 4: Section 4 of Ordinance No. 251-73 (EMC 5.108.030)which reads <br /> as follows: <br /> Section 4: It shall be unlawful for any person under the age of eighteen(18) <br /> years to participate in any way in any gambling activities even though such activities <br /> may be otherwise authorized by the laws of the State of Washington. <br /> Be and the same is hereby amended to read as follows: <br /> Section 4: Forfeiture of Business License. Failure to comply with any provision <br /> of this chapter shall subject the business license issued by the City under the provisions <br /> of Chapter 3. 24 Everett Municipal Code to forfeiture by the person, association, or <br /> organization that so fails such compliance. <br /> Section 5: Section 5 of Ordinance No. 251-73 (EMC 5.108.030)which reads <br /> as follows: <br /> Section 5: Any person found guilty of the violation of any provision of this <br /> chapter shall upon conviction be fined in any sum not exceeding Five Hundred Dollars <br /> ($500.00) or confined in jail for a term not exceeding ninety(90) days, or by both such <br /> fine and imprisonment. <br /> Be and the same is hereby amended to read as follows: <br /> Section 5: Chapter 9.46 RCW violation. Failure to comply with any provision of <br /> this chapter shall constitute a violation of the provisions of Chapter 9.46 RCW. <br /> Section 6: Severability. If any section, sentence, clause, or phrase (i.e., <br /> provision) of this ordinance or its application to any person or circumstance is held <br /> invalid or unconstitutional by a court of competent jurisdiction, such invalidity or <br /> unconstitutionality shall not affect the validity or constitutionality of any other provision, <br /> and the remainder of this ordinance, or the application of such provisions to other persons <br /> or circumstances, shall not be affected. <br /> Section 7: Savings Clause.Nothing contained herein shall be construed as <br /> abating any action now pending under or by virtue of the ordinance herein repealed or as <br /> discontinuing, abating, modifying or altering any tax liability or any tax owing or <br /> assessed under or by virtue of the ordinance herein repealed; or as discontinuing, abating, <br /> modifying or altering any penalty accrued or to accrue; or as affecting the right or <br /> liability of any person, firm or corporation, or as waiving any right of the City under any <br /> 6 <br />
