• <br /> entitled thereto in the manner provided by law. <br /> Section 6: That the city attorney be and he is hereby <br /> authorized and directed to file in the Superior Court in the name of <br /> the city of Averett a petition complying with the requirements and <br /> laws of the state of washington, and praying that just compensation <br /> to be made for the land and other property rights to be taken or <br /> damaged by the establishing apd changing of said grades of said <br /> Averett Avenue, Pine Street and Cedar Street, as provided herein, <br /> be ascertained by a jury, or by the court in case a jury be waived. <br /> Section 7: An assessment shall be made and levied in the <br /> manner provided by law for the purpose of raising the amount necess- <br /> ary to pay the compensation and damages which shall be obtained for <br /> the property taken or damaged as aforesaid, together with the cost <br /> of the proceedings to be had therein, including also the cost of <br /> making and levying, and collecting said assessment. Said assessment <br /> shall be made subject to the provisions of said laws upon said <br /> property specially benefited by said establishing and changing of <br /> said grades , as herein described. Any part of the compensation, <br /> damages or costs that is not finally assessed against said property <br /> benefited thereby shall be paid from the general fund of the city of <br /> Averett.
