EVERETT POLICE MANAGEMENT ASSOCIATION <br />PAGE 12 <br />statements and answer questions pursuant to an internal investigation only <br />after the member’s statement has been compelled. In such instances, the <br />member will be advised that compelled statements cannot be used in <br />subsequent criminal proceedings. In cases where another member is <br />being investigated, witness and other officers will provide statements as <br />required by policy. <br /> <br />8.1.1.6 All interviews shall be limited in scope to activities, circumstances, events, <br />conduct, acts or background which pertain to the incident which is the <br />subject of the investigation. Nothing in this section shall prohibit the City <br />from questioning the member about information which is developed during <br />the course of the interview. All interview attendees shall remain <br />professional, the interview shall be reasonable in length, and the employee <br />shall be entitled to reasonable breaks. <br /> <br />8.1.1.7 If the City records the interview, a copy of the recording of the complete <br />interview of the member shall be furnished, upon request, to the member. <br />If the interviewed employee is subsequently disciplined and any part of any <br />recording is transcribed by the City, the member shall be given a <br />complimentary copy thereof. The Association shall be allowed to record <br />the interview and will provide a copy of the recording to the City. If the <br />Association transcribes the interview, the transcription shall be provided to <br />the City. <br /> <br />8.1.1.8 Investigations shall be completed within 120 days from the date the <br />employee receives notification of the initiation of an internal investigation, <br />provided that internal investigations may be extended for reasonable <br />circumstances. For purposes of calculating the 120 days, an internal <br />investigation shall be deemed complete on the date that the assigned <br />investigator forwards the results of the investigation to the Chief. The <br />Association will be notified when the investigation has been forwarded to <br />the Chief for review. <br /> <br /> If an extension is needed, the City shall notify the Association in writing of <br />the need and basis for the extension. An extension on this basis shall only <br />be for such time necessary to complete additional investigation but no more <br />than thirty (30) additional days at a time without additional notification. <br /> <br />Internal investigations may also be extended, upon agreement by the <br />Association, if the Chief requests further investigation. <br /> <br />In the event an internal investigation has identified potential criminal <br />conduct, the Chief or designee may suspend the internal investigation <br />pending the outcome of the investigation and judicial process. The <br />employee and the Association will be notified if an investigation is <br />suspended, and the suspension will stop all time clocks relating to the <br />investigation. The employee and the Association will be notified when <br />the City resumes the investigation. <br /> <br />Compliance with this Section is required if findings are to be entered or <br />discipline is to be imposed. <br /> <br />8.1.1.9 After an investigation is completed, the member and the Association shall
